Frank I know this has been brought up numerous times before but apparently you simply refuse to acknowledge facts. The HIPAA act protects medical records of all of us including mental health patients.
Protected Health Information. The Privacy Rule protects all "individually identifiable health information" held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper, or oral. The Privacy Rule calls this information "protected health information (PHI)."12
“Individually identifiable health information” is information, including demographic data, that relates to:
the individual’s past, present or future physical or mental health or condition,
the provision of health care to the individual, or
the past, present, or future payment for the provision of health care to the individual,
and that identifies the individual or for which there is a reasonable basis to believe it can be used to identify the individual.13 Individually identifiable health information includes many common identifiers (e.g., name, address, birth date, Social Security Number).
Even the NRA has tried to get this information released but was not successful. This is the reason past shooters have not been reported to the DOJ/NCIC records. But those of you who think that simply passing a law will cause potential shooters to think twice about their actions, the Form 4473 does ask if the person purchasing the firearm has mental health problems. My gosh, one would think the person would answer truthfully on a Federal form, huh? But to our dismay, over 60,000 people lied on the form in one year, a felony under perjury. Who would have thought that would happen? To my knowledge not one of those people who committed perjury was even investigated. Darn the bad luck.
You see Frank we do have protections in place but they are only for honest citizens. Criminals don't obey the laws. I am going easy on you this time because I realize as a Liberal you didn't know that fact.
I hate to tell you this but there is no gun show loop hole as you want us to believe. I believe it is illegal to buy a firearm at a gun show without either doing the Form 4473 there or at a later date at the gun shop. Yes, it is possible for someone to go to a gun show and buy a firearm but both parties would be committing a crime in doing so. You tell us how you will stop that.
As for passing family owned firearms onto heirs or as gifts, I personally see no problem with that practice. The percentage of one of these guns being used in a crime is practically nil to begin with.
But let's say that Federal laws are passed and every state has a law stating that it is illegal to transfer every single firearm in America to someone else without a strict background check prior to the transfer. I am being sarcastic only because you deserve it. If my kids were alive I would leave them all of my firearms. They would say that I gave the firearms to them long before the law was passed which would be true. So now what Frank. Who is going to check these things especially when the incidence of crime with these weapons is so low to begin with?
As an aside Frank let's take a look at the Left's insistence on confiscating assault TYPE rifles. In reality rifles of all types, including the assault type rifles, are among the lowest percentage of any firearms used in crimes. So why the big push from the Left to ban them?
