but you're trespassing when you're right to be there is revoked by someone speaking for the property owners like security.

Not according to Ca. law and the property has to be posted. I don't know about Ohio.

I'm pretty sure they do investigate a property owner complaint of illegal trespass. The security guard felt strongly enough that an illegal trespass was occurring that she placed her hands on someone; we are only lucky that she wasn't carrying a Glock.

That is my point. Violating company policy does not constitute trespass. And you are quite right, it would have been much worse if she had a Glock or Taser or ??

There was no imminent threat to people or property; security guard should have called the police.

But the police do not enforce "company policy" of no photography on mall property.

How man people have been killed or wounded by a gund that the perpetrator thought was empty, my neighbor down the street for one. When I was a policeman I spent six years as a training officer when we got to weapon handling, my first statement was always,"You do not pull your weapon unless you intend to kill."

In all the time you were a policeman, did you ever search for an armed suspect with your weapon drawn?

I see she got fired because, “..the guard did not act properly during the situation that occurred May 9.” Her purpose is to prevent infractions of Policy and Procedure's of the property owner, not incite a riot.
Also, “..the Belmont County Prosecutor's Office still is determining whether to purse charges in the incident.” I hope they do.

Maybe she would still have her job if she followed your line of thinking, Pepper spray them.

Also true, she didn't handle it very well. If you are going go up against a crowed you better be very good and have back up on the way.
She should have told them to stop. Than pepper sprayed anyone recording.

Seriously? Pepper spray them for recording a traffic accident on I-70?

As a retired security officer I have some knowledge about this. One, if the private security officer says no pictures on there property than no pictures. Two, failure to obey an order to leave is a criminal offense. Placing hands on that female is not assault. The officer has every right to enforce a lawful order to cease and desist. The officer also has every right to detain anyone including pepper spray and handcuffing that woman.
True, I don't know the out come if this situation but in most jurisdictions the female would be charged with trespassing and assault on a public safety officer, even though she is a mall security officer.

Her company and the local DA don't appear to agree with you.

Wonder what happened after the video? Where any charges filed?

The guard was fired according to the "update" at the bottom of the page.
It appears the "Security Guard" allowed her mouth to write a check her ass couldn't cash! I'm sorry but when she started counting, I laughed out loud. She obviously lacked training.

NO, we should not expect to see this.

BUT, if we don't soon stand up .... that is exactly what we will be seeing!

Have you or tramsey ever searched for an armed suspect as part of your job? How would you suggest it be done better?

Has anyone had experience with Digital Closeout? I am interested, because their prices are usually 33% or more, less
than typical retail on the net.

There is one very negative report on Ripoff Report:

The address they give is actually listed on the MLS in San Jose and is currently a gift shop!

Not sure that I would do any business with them :?:
