You misread your 4 year old source. It stated the federal prison (BOP) population was 13 % comprised of i******s and 30% of those detained or in custody by the marshals service were i******s. The U S Marshals detain those who were in legal proceedings (pre-trial). They could be in pretrial status for misdemeanors to serious felonies and may have INS holds (to be deported especially during Trump era). When they are in pretrial status the Marshals contract bed space in county jails usually closest to the Federal Court of jurisdiction. Once their case is adjudicated (if found guilty of felony(s) they are then turned over to Federal Board of Prisons and are counted as part of the prison population. People aren’t usually going to go to federal prison for just an immigration violation. That’s kinda like cooking the books on C***d deaths say some died of C***d instead of with C***d (with underlying pre-existing conditions). Someone may be in prison for other offenses with immigration issues and used to be turned over to INS for deportation after serving their sentence. Who knows what they’re doing now.

These numbers go to the makeup of the foreign nationals in jail:

"All told, nearly 60,000 people in Justice Department custody were known or suspected to be aliens.

"Of those, about 38,000 were held in prison, accounting for about 21% of the overall population. Nearly two-thirds were confirmed i*****l i*******ts and most of the rest are still under investigation for their status. Only a tiny fraction of the aliens had legal status.

"As for the marshals, confirmed aliens are 38% of their total population and the vast majority are i*****l i*******ts, the report concluded."

This language goes against the stereotype of i*****l m*****ts as merely seeking economic betterment in America.

You need to reread your report, 13% of the Federal Prison population, and 30% of those being held by US Marshals are i*****l a***ns. Those in custody by the US Marshal Service are held in Federal, State and Local jails, and are not part of the Federal Prison population until they have been found guilty and incarcerated. Those are two totally different numbers, and costs.

You, me and the world knows much has changed re: immigration in the past 4 years.

It is time the illegalities and inequities of the immigration process are addressed.
The primary obstacle is the failure of Congress to overhaul the entire system.

Hopefully this ruling will be upheld on appeal.
