This post is mistitled. There is no "questionable" police action here. The police were clearly in contempt of the mans rights. They KNOW they need probable cause. They KNEW they had none. They intimidated the man knowing his questions were reasonable and politely and non threateningly posed. They battered him for answers to their questions while refusing his simple and reasonable request to know if he were being detained. They damaged his cars finish with a dog no smarter than a trained ape. They illegally detained without informing that they were detaining. They took possession of the vehicle and searched it with no right to do so. They did everything but plant contraband in the vehicle which is certainly not beyond the realm of possibility for people such as these police officers, so willing to display contempt for the rights of the man they were so clearly detaining and holding in custody along with his property. Yes, this post is mis titled.

Jack ass kid has got to remember, that driving is a privilege, not a right. Cops can't see into a car that they have stopped, and they get spooked. They want to be sure that there isn't a gun or something within reach of the driver. INHO any jerk who sets up a cop like this, aught to loose his license, cause he sure as h**l isn't concerned about "Playing nice on the road".

Here is why that means nothing.

The "kid" might have not been as nice to the cops as you'd have liked him to be...he might not have "fit' your idea of what he "should do" but he didn't do anything wrong.

The ONLY ones who are in the wrong in this video are the police.

Being a "jerk" is a judgement call...a "preference" of one behavior over another...like vanilla or chocolate.

Violating the law is another story entirely.

Didn't you get the drift of what a DUI check point is all about ? The cops are trying to get drunk drivers off of the road, not play stupid word games with a jackass.

(_?_) Try, "Interfering with a police officer, in the performance of his duties".

Sure, I understood, I watched the whole video.

And I still say, word games or not...it's a preference that means nothing.

Nope...not at all....he didn't interfere with anything...his PREFERENCE for the window position was DIFFERENT than the cops PREFERENCE.

Big deal.

Are you living under an encroaching infrastructure of a police state. Do you feel safer...

Only watched the first 30 or so seconds but looked like to me the dumb-ass kid just wanted to start something so his video would go viral on youtube. Checked the youtube and it has over 3 million hits. Accomplished his goal. Good job.

Your comment is nonsense. The intentions of the man do not matter at all. The only question is if rights were violated. If they were not, his intentions could not have turned the video into much of anything.

Because his window was not down far enough he was subjected to further search and delay.

Yes, compared to other events, this one is minor. But, it is worth watching, and thinking about what you might do in a similar circumstance.

I was once stopped for some reason that seemed odd to me. However, as the strange actions by one policeman continued another cop car appeared and an apparently more senior policeman put a stop to the whole thing immediately, and sent me on my way.

Unfortunately it is too easy for power to become abusive. Police need to be held accountable for their actions and there needs to be a system of oversight on police methods.

I got as much of the story as I wanted - 21 year-olds can be punks, cops can be a**holes. A number of the youtube commenters thought the kid was being a jerk.

How can assertion of rights constitute being a jerk?

Yes and these are the goons that need to be rooted out, fired with complete loss of pensions, benefits, etc. A clear message and deterrent is all that will stop these over stepping brown shirts.

I was appalled by the behavior of the police, but if anyone has paid into a pension fund, what is the justification of depriving him of its benefits? Life, liberty, and property may be taken only through due process of law (Fifth Amendment).

To you politely asking if one is detained makes one a jackass and a jerk? Police being "spooked" has no legal bearing. The only question is their following the law or not. Even at a checkpoint, as I understand, there must be probable cause for anything other than a brief, half minute stop. They do have the right to have a dog sniff the outside of the car for contraband. This was decided in the Supreme Court case Illinois v. Caballes, but should probably be reviewed. Several studies have shown that 75-80% of the time the dog signals a problem, it is mistaken.

You forget my dear Audwulf, that when you willingly abrogate your own rights, you grant license to a would be Gestapo. Ask any European Jew circa 1940. If you will not assert your rights don't expect anyone else to defend them for if that is the case, you are not worthy.
