That may depend on where you happen to be at the time. Another example might be marijuana. It is legal in places like California, and Washington DC, but not legal in other states. In places like San Francisco, non-citizens can vote. In other states, non-citizens are forbidden to vote.
So, yea, in states like California, ill-legals are welcome. It is only a matter of time before Governor Brown declares them citizens of the Republic of California and by extension citizens of America.

You do know that if a person is here on a visa, they are here legally. It can be for work or visitation.
