I ran into this about 15 yrs. ago, the owner of the animals threatened to call the sheriff and did so when I didn't stop taking photos, I was on my merry way before the law arrived, later that day on my return trip I was stopped and questioned as to my motives, I explained it was a hobby, the animals were in plain view and I was on public property. The Deputy thanked me and apologized for stopping me. End of story.

No this is wrong. You can sell if for profit no gray area at all. You are confusing selling for profit and using for comercial purposes. Comercial as defined by to advertise or promote.

Look at it this way. If you are taking the pic from the road and the owner sees you, you'll have a good head start.

Make sure you get the horse to sign a release.

The horse is likely in a pasture on private land. Usually, there is no problem to make a picture if you physically stay off the land. It is best to ask the owner about photography. Think of it this way: Next time I drive past your home, can I stop and photograph the dog in your yard if I do not come onto your property? Part of the consideration is that of a person in the picture or restriction of some sort.

Be careful where you do pull over to the side of the road. A few years back I was told that the road shoulder was for emergencies only. I go for coffee and a paper every morning. There is a tree along Route 15 outside Gettysburg PA between the Tannytown road and Baltimore Pike exits. On most mornings a hawks sits in a tree along the road. I pulled over one morning on the shoulder one morning to grab some shots. A trooper pulled in after me and I was told that road shoulder was for emergency use and told to move on.

Not familiar with MD traffic laws. It might depend on the nature of the state highway. That said, if there is no law preventing you from stopping on a the particular state highway, I would think there is nothing stopping you from taking a picture.

I have driven that route a number of times, but since I keep my eyes on the road, I would have no way of noticing a hawk in a tree.
