Can I Take This Picture

I live close to Annapolis, MD. On my way into Annapolis, I pass many farms that have horses grazing in the field. My question is: Can I stop my car on a state highway and take a picture of a horse on a private farm? Thanks in advance.

Common sense. If you may safely park your car on the side of the highway, do so, if a patrolman stops he will usually just ask you to move you car. I have yet to have anyone object to taking pictures of livestock on their property.

According to law and U.S. Supreme Court decision, there is no expectation of privacy out in the open. Not that horses have such an expectation.

I do it all the time. I am constantly stopping on state roads to photograph hawks and other wildlife I see in fields or trees along the road side. A few months ago while photographing a hawk along an interstate road. A police officer pulled in behind me. I was just getting into the car as the hawk flew away. He got out of his car and walked to me and asked me if I was having car trouble. I told him no I was trying to photograph a hawk. He bid me a good day and said make sure your off the road when you stop to photograph and he drove away.

Unless there are No Stopping signs posted the you should be able to just pull off. Just get as far off the road as practical and leave your Emergency Lights on. Do not climb any fences either.

You can for private use. If commercial, then you have to have a "property release" from the owner. Or, have an editorial caption and use for editorial use commercially. If it's part of the horse and not anything that makes it unique and identifiable as "said specific horse owned by someone", then it can also be used commercially.

In the USA you can usually take pictures freely from public lands. Obviously you must not create a safety situation on the highway, but that is a different issue. Where might it not be wise to take pics? Military bases might be one thing, police departments, other public security facilities.

Now if your planning to sell the image for profit, and the horses are a significant part of the sale value of the image, there may be a gray area as to consent. I suggest if that is your question, you talk to a legal advisor who specializes in said topics.

Why not just have the horse affix a shoe print to a release. Oh, never mind; most horses over 21 aren't inclined to want to sign.

In horse years 21 would be 70-80.
So a Yearling or Colt would need a guardian hoof print or bite imprint.
