Dicey situation with nude model. What would you photographers do?

I think that morally you did the right thing... but if you had thought to google her at the time of the negotiation you might have found that the photos were a little more valuable to her than what you got paid. That's not to say she should be EXTORTED, but in this day and age of cyberspace when things never go away, the onus is on the customer to recognize the infinite shelf-life and distribution of images, and at the very least, the customer should negotiate the SD card as part of the deal. My opinion as an amateur. (I only take nudes of my puppy and he has no modesty)

I was talking to a photographer friend of mine a few days ago about this - and his reaction was that I could have asked for a much higher buy back fee from the model if I had known that she had become connected to this actor

My response to this basically was that - I would not have asked for anything more because all i really want ( in life ) is to be treated fairly myself - and to do that I believe in treating others fairly

and that no photos in my portfolio are so precious to me that I cannot part with them ( except of course for a couple of shots of certain young woman who went on to become a superduper model (edit ) and my current avatar )

What say You ?



Edit - (Went back to records and clarified minor details)

It was actually 2 mainly nude shoots and a third mainly clothed shoot that I did with her( from what i recall from the third shoot -two thirds of the shoot was clothed )

Total money spent was about $350 ( i now recall paying approx $100 for the hair and makeup for the clothed shoot alone )

Agreed Upon reimbursement back to me was $200 to bury the pix from the 3 shoots

You did the right thing. Gouging her would not have been ethical and you would have regretted the extra $100.

It was kind of you to do this. It is never easy to live in a fishbowl and keep the paparazzi out of your life. Subtle photos in your world are great but when they end up on the cover of people magazine..not so nice. My hats off to you!

Yeah but when I get rich I'm buying more cameras not a fleet of "poloponies".

(Amphoto 1) got this one exactly right. Once pix are posted on the Internet the "pussy" is out of bag!

The photographer did the honorable thing and then was argued with for the small fee to cover expenses.

At that point I would have shut down the offer and charged the commercial fee that any client would have had to pay.

By the way, the Photographer just took the pix down, it doesn't mean he doesn't still own them.

The fact that the model knew they were posted and did nothing for yrs. would imply permission. Not sure what the statue of limitations is in this case but she would look bad in court!

If you were already paid for photo shout then b e a gentleman and take them off ,don't try to make more $ this way you may get more references .
