Dicey situation with nude model. What would you photographers do?

This is from another forum and the post is by another photographer, NOT ME. I have my own opinion as to what is the "right" thing to do. I'm interested in the opinion of other photographers. Especially those who have dealt with similar situations as to models. And not necessarily nude models.

So I did this nude shoot ( well actually two nude shoots ) a about 5 years ago with a beautiful young fashion /glamour model .She appeared to enjoy the experience at the time and was happy with the photos

a couple years later she regretted doing the shoots and wanted the photos taken down - which I agreed to do if she reimbursed me the cost of the two shoots ( Hair , makeup and a piece of clothing I had given her from one of the shoots - so about $200 )

We went back and forth on this issue for about a year and a half ( as she felt I was being unreasonable in asking for any reimbursement ) but finally she agreed , And we settled the matter

I subsequently learned that she had hooked up ( and later married ) an A List Hollywood Actor /Celeb

I was talking to a photographer friend of mine a few days ago about this - and his reaction was that I could have asked for a much higher buy back fee from the model if I had known that she had become connected to this actor

My response to this basically was that - I would not have asked for anything more because all i really want ( in life ) is to be treated fairly myself - and to do that I believe in treating others fairly

and that no photos in my portfolio are so precious to me that I cannot part with them ( except of course for a couple of shots of certain young woman who went on to become a superduper model (edit ) and my current avatar )

What say You ?



Edit - (Went back to records and clarified minor details)

It was actually 2 mainly nude shoots and a third mainly clothed shoot that I did with her( from what i recall from the third shoot -two thirds of the shoot was clothed )

Total money spent was about $350 ( i now recall paying approx $100 for the hair and makeup for the clothed shoot alone )

Agreed Upon reimbursement back to me was $200 to bury the pix from the 3 shoots

I think morally you did the right thing in making a settlement that was not extortionate. You may have lost out slightly, but it does point to the value of both a model release and written contract together with expense records. Without those things in place it would be challenging for either side to place a different value on a settlement.

You walk away with your head high, and who knows, she might even respect you in the morning!

I agree that you did the right thing. Young people frequently do things they later wish they hadn't, and you are to be commended for not taking advantage of that. ;) pith

I think he did the right thing. But the wife of an A-lister arguing about $200 to pay for photo shoots? She was just begging for trouble.

This is why all my photos are rated G...well, except for that one cat photo...

I wouldn't be surprised if here "regret" had something to do with the A-Lister she was married to. Maybe he didn't want to see those shots on a supermarket tabloid. "Mrs. Nobody" is no big deal, but nude pictures of "Mrs. Movie Star" would be something else.

I'm just curious as to whether this girl went on to become an actress herself. If this is the case then she probably did a lot worse for a lot more money. This in no way reflects upon what the photographer did...he did the right thing. I'm just showing my cynical ex nyc bus driver view of the world😁

This was generous of the photographer. The right thing to do would have been to sell the pictures to the model at fair market price. And I guess that would have been about 10 times more or so. But since it was not a totally nude pics they are not worth a fortune, neither in money or reputation for the model so the fair price for the pictures in my mind would have been $2-3000 if I am correct about this. But it was nice of the photographer to practically give away his work to this model. Doubt she will ever give him anything back.

I'm surprised that there were no model releases. I sometimes attend studio shoots and all of the photographers get a model release signed by the models. Sometimes, it's a printed sheet that the model signs. Sometimes, it's done with an app on a smart phone.
It's good that the photos were taken down if she was not comfortable with them.

There was simply no discussion of model releases.

Just from the tone of the post, it sounds as if he or she is a fairly experienced at nude photography and anyone who's doing that knows full well that a signed release is essential... not some ephemeral cellphone app either. It has to be a rock solid and more specific than usual release. Also a copy of the model's driver's license or some other form of proof of age. A lot more than the usual model release.

Photog did the right thing taking the photos down and not trying to exploit them.

But, if the photos were "up there" on the Internet somewhere, I guarantee you the photog taking them down from their own website is just the tip of the iceberg. There are almost undoubtedly copies of the images still floating around somewhere on the web. Once something is online, there's no way to ever truly "delete" it.
