Does an individual have a constitutional right to be racist? I don't mean going out in hoods and burning crosses on a family's front lawn, but I was under the impression that the ACLU always came to bat whenever the first amendment was being trampled on, even if by nazis. I understand that organized sports have their own bylaws, but do they trump the constitution?

I'll say it again - you do not have the right to unfettered free speech. A newspaper has the right to refuse to print a racist or homophobic editorial. A company has the right to discipline an employee for saying something they find offensive. People on the right instinctively run to the Constitution every time an incident like this happens. When Ed Schultz called Laura Ingraham a bitch, he was disciplined. When Martin Bashear made that disgusting remark about Sarah Palin, he was disciplined. You do not have free speech rights anywhere except in relation to government actions to prevent it. When are you people going to understand that? Free speech does not exist in private enterprise. Plain and simple.

So when "Reverend al"lied, and jesse jackson make disparaging remarks about whites and jews ("Hymietown") you guys on the left seem to have a double standard. Liberal "private enterprise" rewards this type of behavior, or else al would not have gotten his own cable show.
How many of us have made private statements which, taken out of context, recorded without our permission or knowledge, and then bruited about, would lead to consequences way beyond the original simple few words - to the gain of other parties by detriment to ourselves?

When the guy bought the team he agreed to conduct himself in accordance to a specific code of conduct. He broke the rules, he did not live up to his part of the bargain, he broke his word and his contract. The NBA is within its rights to enforce its agreed upon rules. Every owner knows what the rules are before they buy the team. I dont know but its my guess this guy has enough money that he has been able to live by his own rules and get away with it. Im glad the NBA is holding him accountable.
OK, the guy is an a$$hole, no doubt. But to be hammered like that for words in a conversation, which he believed to be private, is a knee jerk reaction by the commissioner, in my opinion. Is there one of us in this forum who have never said anything in private that would be offensive to another person of another race, religion, etc? Censured he should be, fined even. But banned is too much.

No, can't agree with you as it wasn't a court, it was the decision of the head of the league. The court will come into effect IF he is dumb enough to fight it.
