Thanks for all the comments and for the website reference http://www.resellerratings.com/ where I found the same events that happened to me has happened to others. My gut said don't buy from this .com, but I did anyway. The site is BuyHerePhoto.com. I did receive an email the next day after I ordered it indicating the lens has been shipped. Not sure if I have any recourse other than to send it back and pay restocking fee and then I wouldn't be sure they would process my refund. I'm not sure I would do this if it is the correct lens, but I am leaning towards returning it, regardless, for the principle. Thanks again for your comments. I WILL NEVER BUY FROM BuyHerePhoto.com again!

When you get the lens check the serial number, it will start with "us" if it is a lens with a USA warranty.

Thanks. I'll look for the US identifier.

I got my camera and one of my lenses from Crutchfield. They have excellent customer service and are definitely on the up and up. Their price is not usually the best but I use my Discover card cash back money and for every $40.00 of my cash back I get $50.00 to spend at Crutchfield. That usually seems to make up for the slightly higher price.

I believe that another reason not to accept AMEX is that they will come back on them if there are problems with product.

SCAM ALERT

Please let us know which supplier it was after you get it returned etc. This is a scam without a doubt. Asking for another credit card is the give away here.

Unscrupulous mail order places do not like AmX since it costs them more to process. And they are hoping you will then provide themwith your next most active card number which is, more often than not, a "debit" card with a credit card symbol on it. They can be long gone with the debit card number and you will have little or no recourse. The stories I could tell.

Cancel the order, ask to have an e-mail notification of the charge back when the RMA is received and contest any charges.

Notify the credit card provider immediately to cancel the number and monitor your credit card charges hourly until they tell you the card has been cancelled. You could easily have unauthorized charges by now.

Holidays and credit cards make it way too easy for customers to get cheated just like this sequence you experienced.

There is one other explanation (though I do think this place is not reputable).

Some lenses don't work with the D40 because of losing auto focus. They can only use lenses with built in focus motor.

Most Nikons have motors in the camera and can use all lenses(note: a few exceptions) whether they have or don't have motors in the lens. D40 has no camera based auto focus motor.

It would have nothing to do with DX or FX sensor. The 'technician/sales person' was not knowledable about photographic equipment. Another reason to steer clear of them. My personal choice at any price is B&H.

DID YOU CANCEL THAT CREDIT CARD YET!!

Was it a credit card or a debit card with a CC symbol?

Check your credit card status hourly until that card is canceled. You have to mitigate damages... Odds are they will double charge you late tonight or tomorrow so it won't show up on your statement until sometime Monday. Your card has already been charged if the item has been shipped. Double charges are not a simple mistakes.

Thanks for your advice about my Credit Card account. I will check the account online several times a day. And can also check the pending file before the actual charge posts. This is just a lesson to me to pay attention to "that little voice".

"I'm thinking I may have been "taken" by the website that sold me this lens. After placing my order and paying with AMX I received an email saying they needed more info before processing my order. I called and it took a long time before a live body answered, then he transferred me to someone else. Another long wait. I was told their AMX processing was down for 2 months and I would have to pay with another card. Before long the rep wanted to know what camera I had. I told him and he said the lens I ordered wouldn't fit and I would have to have the "other" version for $80 more. I was hesitant but said ok. Does this sound like a scam to you? I'm anxious to see exactly which lens they send me."

Well, I received my lens a week later...only problem was it was not the lens I thought I was getting. The "other" version turns out to be a Sigma 18-200mm they sold me for $429. I had no idea I would be getting a Sigma. I'm sure Sigma is a good product, but the price at other sites ranges from $279 - $369. I am convinced this company (BuyHerePhoto.com) does not even have nor intends to sell the Nikon lens they advertised.

I called the company and after much haggling, defending, and trying to give me free filters if I would keep the lens, the rep agreed to take the lens back and give me a full refund if I included a check for $57.80 restocking fee. I told him I would, but I would be writing a review of his business practices on every website review format I could find, but I will wait until I receive my refund. I'm crossing my fingers that my money will actually be refunded, but I wouldn't be surprised if BuyHerePhoto closed shop and opened under another name. I have now read all the reviews for this company at www.resellersratings.com and will be adding my own lengthy account of my dealings with them.

Stay tuned....

The difference between the VR I and the VR II apart from about $400 is that the VR has been improved and users say, by quite a bit too. So the $80 difference would not make sense either, between a VR I and II lens. Usually your credit card company can help to sort out a problem like this and they will fight on your behalf. If you ordered a Nikon lens and they sent you a non Nikon lens then you should not have to pay any restocking fee. The most would be the return shipping and be sure it is trackable for a few dollars more.

Another SCAM site is Mellodigital.com
Their specialty is bait and switch. Get you to order a name brand item "in stock" and them call you with a back-order sob story and try to get you to spend too much for some off brand crap. Don't get caught up in their BS.
Sure wish UHH had a regular link for disreputable dealers, might go a long way towards putting many of them out of business.
"BuyHerePhoto.com" and "FirstClassDigital.com" as well as 3 or 4 other names, are all exactly the same website as you can tell by their layout, only the phone number ever changes between them. They are also classic "bait and switch" sites.
