Gross negligence is a different legal standard than negligence.

Most tasers are not yellow...the ones I have seen are black with a yellow or orange muzzle tip...they are broader and thicker than a Glock.

Her mistake likey constitutes negligence, but perhaps not gross negligence. I use to be more familiar with the difference, but it has been many years since I took a law course.

Many state laws protect cops from their negligence but not gross negligence.

Concerning the taser . It was yellow and on opposite as her gun which was on her dominant hand side .

The only stupid comment made was the one I am replying to. Do you suppose she had Superman's xray vision and could see no firearm in the car, if so then hang her, if not accept the fact that resisting, combating, and attempting to re-enter his car put the officers in fear of death. You are not that dense are you? Why is that 99.9% of police shootings involve Criminals and felons.

Please you are bending over backward trying to find an excuse for her killing an unarmed person who was trying to drive away..

There is no excuse so quit looking !

I am not looking for an excuse, just pointing out that people make mistakes in times of stress such as this were. The knee jerk reactions to this incident was caused by the sensational claims made by the press within minutes of the incident.

Absolutely correct. Nothing to do with race. But it is another excuse to riot and loot.

Everybody makes mistakes. This was A big mistake. But S_ _t happens. However, this is another reason to cooperate with an officer who is armed.

Struggling to get back into a vehicle that has not been completely searched is a threatening move. Getting loose of police control escalated the situation. From the time that he started to struggle, till the time he was fatally wounded took about 3 seconds. He made a choice between going to lockup or going to the morgue, he chose the morgue.

When someone puts the police in the situation of having to use force accidents will happen. He traded his life for ruining the police officer's career. It seems like an even trade to me. I wouldn't charge her with a thing, but I'd fire her. As it is, her poor training is going to cost more lives and millions in property damage.

Snopes has unraveled the unsimple issue with Duante Wright. After you digest the video go to Snopes to get the rest of the story. There is more than one government document to digest.

Anybody mention that Ashley Babbit was shot and killed by a white cop. But that was an accident and the cop was not charged. WTF?

I can give her the excuse of making a mistake but she pays the price - 4 to 10 for negligent manslaughter.

By the way what claims by the press?? Every one that I read said accident !!

A little different don’t you think ?
The crowd smashed the glass with a helmet and stick, according to video footage. Seconds later, Ms. Babbitt, who was unarmed, attempted to jump through the shattered glass and was shot by a Capitol Police officer from inside the doorway, according to the footage.

Multiple videos of the shooting posted on social media showed Ms. Babbitt, who appears to be wearing a Trump flag as a cape, falling from a smashed-out window after being shot by an officer on the other side of a set of double doors.

He did not ruin her career. She did. Pilots, architects, engineers, and a myriad of others are held to higher standards than cops. Do you really believe that is how it should be?

Poor analogy. Pilots certainly could be put in a situation where they are making snap decisions that affect human life, but while engineers and architects make important safety decisions in their careers, they are not made rapidly and critical decisions are peer-reviewed. You won't find bridges, cars, or buildings with critical loading designed and executed by one person.

Units in the military that might be forward deployed train constantly, the police train occasionally, and when they are not training they are working, two different situations. Some of their training is reinforced in their workaday world, some of it is not. I would hope the decision to use deadly force is not something they encounter every day.

This woman made a mistake that she might not make on any other day in any other situation. Some people are talking about the obvious color difference between a taser and a gun when she probably did not look down. The harm done to the profession and recruitment has to be considered in this situation. Ultimately, Dante Wright put into motion the events that led to his accidental execution. His behavior is the root cause of his own death. There is no other way to interpret the data.
