Paypal and e-bay will stand behind you if the product is defective; their business model depends on it. Seller has the option of not accepting the return but does not have the option of returning your money in the case of a defective or counterfeit product. I know, I've been there. Just call e-Bay.

Thx for your advice - I have requested a return through ebay. I will advise the outcome.

Had a problem with rattle in lens and called the manufacturer (Sigma) talk to tec-rep put on camera went through a process (that I do not remember) solved the problem, something to do with VR and the way it was removed from or put on the camera at some point. I have never had a problem again (5years).

Thx for info

In addition to the great suggestions, if you have a smart phone, I would make a video capturing the sound. Then, you would have "proof" of the sound and the type of sound. I have found when I attach my files to a claim, it settles in my favor. HTH!

I can’t guess. I have bought computer / photo gear on Ebay three times....and been screwed by old, defective sh*t each time. Never again. I would not get anything from Ebay, now, if the sellers paid me to take it off their hands. I have enough trash of my own, and do not need anyone else’s. From the ‘sound’ of it (Ha,ha) you would do well to take your loss, and adopt my policy from now on....no more contact with Ebay for any reason....not even return / refund efforts.

Thanks for reply - my problem was really about what might the rattle be. Yes - I did pay through PayPal.
With seller not accepting returns it just gets more complicated, but I have requested a return.

The seller can be compelled to accept a return if the item is not as described in the auction. If he made any representation that it was functional as new, not just cosmetically like new, you have grounds. Otherwise, you should have asked how it was working, was it tested on a camera etc prior to purchase.

Oh, also, if it was not as described, the seller has to refund everything, including return shipping.

The seller CANNOT refuse to take a return, no matter what he puts on his add. Notify him you want to return. If he refusses, contact paypal and put in a report.
Product was NOT as advertized. He HAS to take it back. Paypal will also demand it.

Seller can absolutely refuse to take a return, unless he misrepresented the item. A simple "Sold As Is" is enough to enable the seller to refuse a return. A simple direct question like "does the lens work like a new lens" with a response of "yes" is enough to be able to compel accepting a return. I think that is what you are implying, but the third word in your first sentence might be misleading. Just sayin'

Hi Gene, Bill,
Lens advertised on ebay as "opened unused" and sellers ebay description says "this lens is in brand new condition"
It looks fine, but there is a rattle from the inside. So far I have only unwrapped it, and then requested to return it through ebay. They have replied to say that the seller now has until 2nd August to respond, after which I can ask them to step in.
As I see it, because of something loose rattling inside, it is not in "brand new condition". I can only hope that, if the seller does not accept a return, ebay agrees with me.

Hi Linda,
thanks for suggestion - I shall wait until I have a response from the seller or ebay, then that could be a good idea.

If you read my last line, I specified if the product was not as advertised. Next time read all of the post before responding. Thank you.

And this is a problem you cannot take care of all by your little self?
OK grasshopper. Let me tell you what would happen if this happened to me.
I would notify the seller that I am returning the lens because something is rattling from within the lens. If the seller did not confirm the return within 2 days I would open a case with ebay.
I hope you paid through Paypal. Once the case is open, they will give the seller a limited amount of time to OK your return.
Trust me, Ebay and Paypal will take care of you. I have had to open two cases over my 15 years in doing business on Ebay and both times Paypal and Ebay stood by me and we got the issue resolved.
Good luck grasshopper.
And this is a problem you cannot take care of all ... (show quote)

So simple, it plumb evaded him.

No returns means you will probably get the lens free.
At this point the seller would lose MORE money if returned.
The rattle, wait tell you have your money back and find out.
Now nothing to lose.
By the way, this has been my experience three times.
Ebay and pay pal never entered into the matter.

I have just received a 14-45, f3.5-5.6 Panasonic lens advertised on ebay as opened unused and seller described as "this lens is in brand new condition"
The lens does look brand new, however, there is a rattling sound from inside the lens whenever it is moved gently in my hand. What could this be, and would it be in keeping with a lens "in brand new condition"? I have not yet attached it to a camera or otherwise tested it.
Thanks for any observations.

Ebay/PayPal should protect you. Sometimes PayPal will even cover return postage. Check with them.
