Beware of no trespassing signs and obey. You never know when that wooded trail or old barn houses a still or illegal drug processing or growing area. I like to hike and photograph in remote areas but pay attention to no trespassing signs. They may come with buckshot.

Yes, we are thinking along the same lines. I think one problem is that there are so many laws and old laws on the books still that even law enforcement doesn’t know many of them. But if they want to find something they can come up with something. We seem to have a multiple tier legal system in this country.

Nearly 40 years ago I was cited out of state when I passed a car and he made a left turn into me causing a decent accident. There was no markings on the highway for no passing zone and no marking for any road intersection. The guy didn’t signal and turned into my right side and I was passing. I was cited for not blowing the horn while passing which if I recall was a law dating back to the 19 teens. Ridiculous but still on the books.

Obviously I cannot speak for the two differing opinions of the deputies as I wasn't there. I can point out that enforcing the law is sometimes a thing where some LEO especially new officers see every law to be written up in a citation or the person arrested. But in most infractions or crimes whether traffic violations or criminal violations there is also a warning that can be given rather than a citation (a form of arrest) or a physical arrest (taken to jail and booked). IF you were not supposed to be there for whatever reason, could be city/county/state violation, the first deputy could have/should have at least warned you of the violation. That way you would not have been there to receive a citation by the second deputy. I hope that makes sense. He could have been nice about it and explained he was not going to cite you but in reality there was an ordnance/law stating you were in violation. If true he did you no favors.

Perhaps the second deputy was new and thought he was in the right and you were committing an offense. I would definitely recommend you take this to court so as to have the deputy explain exactly why you received the citation. IF you were in violation then you have the opportunity to explain to the judge you had been contacted previously by the other deputy who said nothing.

Again I wasn't there so am only offering some what ifs.

Now THAT was a screwed up deal for you. I have never heard of that law from anywhere. Normally it is the person making the turn who has the responsibility of turning safely after checking to be sure there is nobody in his way. How could he not see you right on his side unless you were still in his blind spot. But still the responsibility for turning safely is his responsibility. That sucks.

How an anyone woder about what's right and wrong about property rights? Think of all the folk so involved in their cellphones they are no longer a real part of the social scheme of things. They have removed themselves from "reality" to another world where only they exist. They are enraptured in themselves and the phones and are unaware others exist, so a "No Trespassing" does not apply to them, has no meaning to them becauae it is not on their cell phone, so they will trespass without care for anyone else.

It as in rural northeast Ohio and a state highway patrol gave me the ticket since the little burg was too small to have any police. Took 45 minutes to get the police there. Guy that hit me had a junker POS that was a bondo explosion when he it me. My truck was 3 months old and he took out the whole right side from headlight to bumper. The final insult was my insurance company bought the guy another car...and I had a witness riding in the passenger seat. Classic you are from out of state so we are gonna screw you over deal in my view...

With all due respect I think that might be one of the weakest arguments I have ever heard. Yes people are caught up in their cell phones and in their own petty lives. But giving that as an excuse for trespassing just doesn’t work for me.

It's not posited as an excuse just as a reason.it seems many folk do not care for one another, but only themselves. Think not? Ask where has all the toilet paper gone? Or so many other staples in the food department, as milk, pasta, spaghetti sauce, canned soup to name a few. It's Henny Penny crying about the sky falling down with no regard to what is actually happening. This way fences do not matter.

It's called entitlement. Lack of morals and values. Disrespect for others. Parental failure.

it's worse than that. They never look up from their screens. They have no idea where they are. I have seen people trip over obstacles and fall on the ground because they were staring at their phones while walking. I have used a smart phone for years, but I don't let it take over my life. One time I lost it, and didn't find it for a week. It wasn't a crisis. No one was hurt, and I didn't spend the days crying. I understand some people have to be available all the time for business or medical reasons, but for the rest of us it's a generational thing. People over 50 are far less likely to be victims of phone-hypnosis.

Here in Massachusetts, we have another unofficial traffic law. It states that no driver can never allow a car to make a left turn in front of them. If you're making a left turn, you can wait a half hour until one rare good citizen gives you a break. We used to be the #1 state in the country for per-capita traffic accidents, until we lost it to Rhode Island.

A lot of people think that public (common) space is their living room (think cinemas). And private property is an alien concept, unless it's their own. I refer to it as the "center of the universe" syndrome.

And to those that say they're so important they have to have their phones on, I tell them they're not: the REALLY important people have flunkies like them to handle the "noise".
