Here's one for you. The fourth amendment doesn't protect you any longer if you live within 100 miles of any US border in the interest of national security.

Perhaps he is referring to the powers of INS and the Border Patrol or what ever they're called. I've seen them stopping cars well within our border.
Now this also reminds me of two stories that I've read in the news in the last ten years or so. In one case, someone bought a used car and went to Canada. When they came back, the government stole their car because a drug sniffing dog detected residue from drugs. The problem here is the "seizure" part. They had no drug conviction and they faced no jury. Their property was taken with no recourse. The second story was about a family that took $28000 in cash to another state to be a special needs equipped van. At some point in the trip, they got stopped and their cash was stolen by law enforcement because it could have been "drug money". It was a big front page sob story in our local newspaper.
In both cases, proof of guilt of a crime was not required and the penalty was enacted prior to any kind of review. This certainly is a loss of freedom to do something that is not illegal and still be penalized by the government.
