I'm sorry you are incorrect. Flickr does NOT claim ownership of images posted on their site and users do NOT give up their rights to their photos.

The TOS for flickr state:

Yahoo! does not claim ownership of Content you submit or make available for inclusion on the Yahoo! Services. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Yahoo! Services, you grant Yahoo! the following worldwide, royalty-free and non-exclusive license(s)


which means they can use your images to promote Flickr for free (a trade-off for using the free service) but can not sell them or claim copyright.

Have you looked at the TOS for this site? It's not as clearly written.

OK, so, Flickr does not usurp ownership of one's photos, but it does appear that they can use them as they wish (not just for promotional purposes), which is tantamount to ownership/copyright.
Question: In your quoting of the "TOS" is that from Flickr? If so, it does look like a claim of ownership.

My second quote showing the TOS that is so poorly written that it could legally claim ownership of any images posted is from THIS website (uglyhedge.com)

flickr 's tos states they can use your images only to promote flickr or yahoo as whole. they can not sell my images or change them in anyway, this includes cropping or removing watermarks.
