The COTUS made no mention of b****s or w****s ... so it was legislation from the bench.

But the Constitution does mentions s***es and property rights. Dred Scott was the textualist ruling.

The Dred Scott decision included that no person of African descent could be a citizen of the United States, s***e or not.

Nothing in the COTUS said anything close to that.

Dred Scott was legislation from the bench, plain and simple.
