This is actually(more technically) a 'Black and Yellow Argiope' and female I believe. You maybe wondering why I mentioned the Black and Yellow. But there are other species of the Argiope, i.e. the Silver Argiope. So I'm not just stating the obvious colors, but that is actually part of the true name. "Garden Spider is more of a common 'nickname', if you will.
I believe that is my ex wife. :)
