42ns Street Photo's Restocking Nightmare

This is actually one of the better incident reports we have heard about here on the Hog concerning 42nd Street, IMO. They didn't try to up-sell you through any of a number of methods. You apparently got what you ordered, in a timely fashion. Since you decided to keep it you apparently opened the packages and do not seem to have noticed any missing components, which you would then have to buy. If this had been a straight-up purchase you would seem to have gotten overall good service. Not the norm in many cases with 42nd, from what others have related. Instead, you got hit with a restocking fee that, in comparison to the major camera retailers, is ridiculously high. Obviously, their intention is that merchandise not be returned and that customer service is secondary to that. They know the chances of a customer pursuing that legally are slim to none.
I would suggest that, if you haven't already, you check to make sure that all the normally supplied components were included. If you bought under the assumption that the items carry a USA warranty then you would be wise to make sure they are USA and not grey market. So far as I know 42nd is not an authorized dealer for any of the major brands. I would also pay close attention to your credit card statement for any unexpected fees.
There are multiple reports here on the Hog and on other sites that 42nd, while sometimes quite satisfactory, is usually pretty chancy to deal with. I know you were in a rush, but the bottom line is, counselor, that in dealing with a company you appear to have been unfamiliar with, you didn't do your homework. I hope your clients affairs receive more attention then you gave your own.

I have found that credit card companies are very good at working with you in these instances. If you had just challenged the credit card charge you would have had their merchandise/money tied up until some settlement could be reached. Usually when you do this they will cave so they can get their merchandise back on the shelf.

Likely you mentioned that you were anxious to receive the items for the trip (as you did in the message above), 42nd ripped it out for you. Two thumbs up to them for that rush in a busy time of the year. You got what you bought. Is 42nd the blame? Not in this sale. Enjoy the new gear on the January trip.
That said, I'd never call or order from 42nd street photo, and never is a long time.

Another problem to be aware of, when you receive your order check the ser# on the equipment and on the box. Often they will switch the equipment to Grey equipment that has no US warranty. I got burned when I purchased a camera several years ago...Never again! only trusted camera shops now...

Sad story. You have never been in business for yourself and think returning something should cost you nothing. How about shipping? This is a good lesson for you and others who think the same.

Ouch sorry to hear...Walter is the "nice" guy that turned my life into a nightmare on an $1800 lens sale this last year. It took 10 months to fix and a lot of work to get a remedy. I did not have a clue how bad this company was until I read the on line complaints and tried to react. I cancelled only minutes after purchasing to boot but he told me it was too late. 42 held out to the end with deception on shipping and even used a fictitious address to try to convince my CC company I had it shipped it elsewhere. The worst part is I never received anything except profanity and lies from nice guy Walter. DO NOT PURCHASE FROM 42nd EVER!

William!

I urge/insist you to cite your experience on www.resellerratimgs.com and give the lowest rating possible. A 42nd Street manager named Jonathan monitors that site. I'll bet he will call you and make things right.

42nd Street Photo operates this way. They sell GRAY MARKET goods. Whenever I want to order (gray market) from them I go through Jonathan first.

Good luck,
Ponz

I will make this as short as possible. On December 23 at about 4:30 P.M. CST, I had the urge to order about $4000 in camera stuff from 42nd Street Photo. I did this through Ralph by telephone. About forty minutes later, after having a changed of mind, I called and left a message that I wanted to cancel. Apparently 42nd Street had closed.

I normally order from Adorama or B & H, but both were closed for religious observances on Friday, December 23. Time was a factor, because of a European trip scheduled for early January, so I resorted to 42nd Street.

On Saturday, December 24, I called 42nd Street in the morning and told Walter that I had left a message the day before that I wanted to cancel. He told me the order had already gone out, so I just needed to receive the shipment and then call back for instructions on how to cancel, and there would be no problem. I told Walter I would do that.

This shipment arrived today at about noon, Mississippi time. I promptly called 42nd Street and spoke to Walter about returning the merchandise. He told me that there would be a 20% restocking charge. Based on the order, that would be about $800. I told told him that I had barely touched the merchandise, but he insisted that the charge would apply.

I told Walter I was unaware of the 20% restocking charge. He specifically told me that, "We never tell our customers about the restocking charge." I asked Walter why customers were never told this. Walter said, "Because it is on or website." I told sweet Walter that I ordered by telephone, not by website. Walter said that there was nothing he could do about this.

To his credit, however, Walter put me on hold and came back to tell me that he had authority to reduce the re-stocking fee to 15% (or about $600).

Ok, I am familiar with the narrow profit margins for sellers of cameras. If I keep the merchandise, there is a modest profit for the seller. If I return the merchandise, there is a 15% payment for "restocking" but the seller still has possession of the merchandise. Basically, 42nd would receive a $600 payment for receiving a package, the contents of which have not been disturbed. Nice profit for no sale.

I have chosen to keep the merchandise. Fortunately, I can afford to pay. But that is not the point.

As a lawyer, I know that a deal is a deal, and I ordered the merchandise. The seller has no obligation to take it back. That is all well and good. But my problem is with Walter's saying that his company never tells the customer about the 20 percent restocking fee. They really don't have too, but I can assure those reading this that I will never--I mean never--order again form 42nd Street. You guys can do what you want. Just beware.

We live and learn. I will stick with B&H and Adorama in the future. The "boys" at 42nd Street can do whatever the heck they want. I will rejoice knowing that I never have to deal with Walter, Ralph or any of those 42nd Street guys again for the rest of my life. I hope they have a conscience, but I really don't know, especially after Walter saw fit to interrogate me about why I wanted to cancel my order. I don't cuss, but if I did, I would know exactly what to say to this guy.

Ok, it is bedtime in Mississippi. Good night to all of you Hogs reading this.
I will make this as short as possible. On December... (show quote)

Back in the 60's - 70's, there was a store called 47th Street Photo. they were reputable. What a difference 5 blocks and a similar sounding street number can make.

They still exist also.

As an aside: You'll find the equipment the same as with a USA warranty. When Jonathan calls you have him provide their own warranty for free or greatly discounted.

Here's his info, but go the route I suggested first:

If you paid by credit card look to them for leverage and relief. The story just does not bode. I would be more concerned about Grey Goods than anything. Good luck.

If time to get your camera and lenses was of utmost importance, why didn't you go to any of the many reputable dealers in the market? Cameta, Hunt just to mention two of them had been far better choices than those crooks at 42nd Street Camera. I dealt with them with a lens many years ago and although everything went well I was a witness to their poor business practices.
This is a subject that surfaces once in a while in the forums, some of the members have been luckier than you because we warned them about 42nd Street Camera. For others it was too late when they told us about their experience at that store. They simply are not serious conducting business and by the way, perhaps they do not accept merchandise that have been bought and returned but all of the other reputable dealers I know do without nailing anyone with a 20% restock fee.
I know that you have learned your lesson. In the future keep on ordering from Adorama and B&H. You will never regret buying from them.
I am sorry you had such a bad experience.
