42ns Street Photo's Restocking Nightmare

Most likely they would have just charged the $800 to his account upon its arrival. They did after all, already have his CC# and deception is their game. And they are damn good at it!!!
It was a lose-lose no matter what.
Let's just hope what he ordered was really what he wanted and will be happy with it and not have problems with it since it's likely all grey marked!!

I did PM him three days ago (I think) and suggested he contact his CC company and DISPUTE the charge, explaining the circumstances and notorious reputation of the business. I know I have successfully disputed a few charges on my CC.

I haven't dealt with mail order sites. I am blessed by having a very good camera shop near, (The Camera Shop in Bryn Mawr Pa 19010) which has served me well. I know that living in areas away from large cities is very difficult to access personal sales staff. But I have check the store for reliability; in dealing with phone orders the person talking to you may forget to mention such very important details, in which case the seller should make good on what they said.
I wouldn't let it go. I was manager for a retail store and when speaking to a customer for this or any other issues, listening to costumers is just good business.
I feel for you..... and will pass this information to everyone I know.

I have never needed lens service during the warranty period since I started buying serious gear in 1969. I do buy USA warranted new cameras, but have bought mostly gray market and used lenses since. Nary a problem. I pocket the savings as self-insurance against failures.

Your interpretation of the OP was probably much more correct than mine. I interpreted it as a quandary he had faced, and, after making a decision, was, in a subtle manner, seeking affirmation of his choice. But I still don't understand an attorney giving up that easily. Maybe he's very successful and $4K means nothing to him.

Burk, My question is not to pin you to the wall but I do value your option. WOULD YOU NOW BUY A GREY MARKET? I don't shoot Nikon but if I did I would never want to have product that I could not get repaired. I have in the last few months bought Tokina Tamron sigma and Canon. I went out of my way to make sure it was not GM.

Yes. Just lenses under $1000. No bodies or expensive glass.

Most Micro Four Thirds lenses are under $1000, including several Leica primes. Hardly throwaway lenses.

I used to use Canons and Nikons...

I didn't think there was anyone involved in photography for any amount of time, except maybe someone just starting out with no experience whatsover that didn't know what a RIPOFF outfit 42nd Street Photo is. I knew about them and their reputation more than 20 years ago. They have a reputation for bait and switch, changing items, not sending what you ordered, etc. You did order the goods so its on you. You could have hopefully called your CC and put a stop payment on the order right away, and also refused to accept the delivery of the shipment when it came if you were able to stop the CC transaction in time. Hopefully, you will enjoy and get good use out of whatever you ordered. Just don't ever, under any circumstance, order anything from 42nd St Photo ever again.

Why after all that has been said about 42ND street camera would anyone even think of going to them........add some other small sips but b&h and Adorama have a great deserved history and good prices

Save the headaches stop with the 42ND street

Can we ban those posts?

Walter said, "Because it is on or website." I told sweet Walter that I ordered by telephone, not by website. Walter said that there was nothing he could do about this.

To his credit, however, Walter put me on hold and came back to tell me that he had authority to reduce the re-stocking fee to 15% (or about $600).

Ok, I am familiar with the narrow profit margins for sellers of cameras. If I keep the merchandise, there is a modest profit for the seller. If I return the merchandise, there is a 15% payment for "restocking" but the seller still has possession of the merchandise. Basically, 42nd would receive a $600 payment for receiving a package, the contents of which have not been disturbed. Nice profit for no sale.

I have chosen to keep the merchandise. Fortunately, I can afford to pay. But that is not the point.

As a lawyer, I know that a deal is a deal, and I ordered the merchandise. The seller has no obligation to take it back. That is all well and good. But my problem is with Walter's saying that his company never tells the customer about the 20 percent restocking fee. They really don't have too, but I can assure those reading this that I will never--I mean never--order again form 42nd Street. You guys can do what you want. Just beware.

We live and learn. I will stick with B&H and Adorama in the future. The "boys" at 42nd Street can do whatever the heck they want. I will rejoice knowing that I never have to deal with Walter, Ralph or any of those 42nd Street guys again for the rest of my life. I hope they have a conscience, but I really don't know, especially after Walter saw fit to interrogate me about why I wanted to cancel my order. I don't cuss, but if I did, I would know exactly what to say to this guy.

well I look at it this way... bad publicity on a social media like this means that that company has lost a lot of potential sales. I own and operate my own photography business and if for any reason one of my clients need some changes or refunds I consider that this customer has friends and could cost me. But actually I am a big believer in giving my customers a fair shake even if it cost me.

(I realize this is an old thread) But OP ordered some stuff. It was shipped promptly. No problem there.
Not sure I've ever ever been told restocking fees at time of purchase - by anyone. Does Wal-Mart tell you, or any department store or your local auto parts store?

What else would you expect from them?? Everybody saying to stay away from them, don't do that for nothing!!!
