I was taking pictures of trees in a local park. And there were a few groups with the public grills fired up.

Smoke was drifting thought the trees.
So I get up as high as I could and started taking pictures.
All of a sudden I got this fellow in my face saying that I could not take a picture of his smoke!
I turned to him and notice that he was holding a BD party for his son. Also there was not one camera in site. So with my broken Russian I offered to take pictures of his kids party and give him the 1 G photo card. But then I had 3 guys in my face.
So what say you, who's smoke is it?

PS: I was using my 50mm Nifty Fifty an as it was getting late i was using A-P and slowing down the shutter, with a small increase in ISO.

If you are on public property in the US, you can take pictures of people having a B Day party...they are in the wrong.

Print out a copy of the photographers rights PDF and keep it with you to "educate" those who don't know that. :)

In a situation like that, might makes right. I wonder how impressed those three Russians(?) would be with a piece of paper?

I would sue him for making me breathe the potentially toxic smoke in a public area!

I actually agree here since it was in a public place that you are in the right since you were focusing on the smoke and not the people.

Size matters in this case. Don't ever bring a piece of paper to a gun-fight. Otherwise, you will have had your last birthday. Glad you;re safe.

I once photographed down on the Providence RI waterfront. 2 guys leaped out of a dark camaro (tinted windows). They ran right into my view.Dropped a box of Arm and Hammar baking soda under a pine.I'm 5-8. They were over 6 ft. One of them yelled at me from 2 t away to put the _______ camera away a. My momma didn't raise no fool. Camera in the bag. They left. I shook all the way to the car. Prov PD near by. The cops recovered 20 K cocaine per Prov J-B on next day.

The OP didn't say that they were large and he didn't say that they were Russian, everyone is now making up scenarios that don't exist. :)

Looking at it from the point of view of the birthday party dads, if I looked up and saw a guy with a camera, high up as Dietxanadu said (not sure if that meant he climbed into a tree), I might think he was some sort of pervert who liked to take pictures of little boys for purposes that aren't exactly pure.

And taking pictures of someone who's made it clear they don't want their picture taken is not a good idea. You can't make anything from the sale of those photos unless you're a working journalist and the newspaper, magazine or website you working for is paying for them. If you can't sell the photos, how are you going to pay for your medical bills when you get the crap kicked out of you and the guys who did it are unemployed and judgement proof?

Just my 2ยข worth.

Untrue.

This has been hashed out to death here on the UHH.
