Hi I would be grateful for any help. I have been asked by a new training provider if I would let them put my orb pictures on their wall , ( I have some in frames) also they would like to buy digital images to print their own and I presume sell them. My query is what would be a fair price and do I retain copy write on them. As I have not been asked this before I would be very grateful for info from the people who have knowledge of this. Many thanks.

I guess it's up to the individual, but I would never, ever sell my digital (originals), unless it was a tremendously large $$$ amount. I still have every negative I shot while in business as a portrait photographer. It's the negative and/or the digital version of the photo that establishes you as owner.

Sell them the prints for a fair price depending on the size and quality of the framing job/materials.

Selling the digital files - I'd start at $300 - $500/image for just the rights to reproduce them for display only - not sale. If they want to sell them then I'd start at perhaps $1500 per digital image if you retain the copyright. If you relinquish all rights then the price would go up quite a bit.

DO NOT FALL for the "It will give you exposure". You are already exposed, they came to you.

Printing: Do what the 'market can bear' meaning do not over price yourself so that they lose interest. That is it for pricing.

Selling the image on a digital form. Once again, what the market can bear. In addition you do not sell the original but a copyrighted version* of it with (strict) limits** on use such as re-print for profit (Price + % is normal) Print for promotion, web site use with credential and limited size.

* Meaning that you not only retain the 'real stuff' but also you can sell it again but as a different version, cropping, adjustment, anything as long as more than nominally different.
** Up to you here

Nanaval,
You can sell your prints under several different options.
1. You sell a print for one time use. (What it cost for you to create and print + 50%)
2. You sell a print for local distribution. (What it cost for you to create, print, and deliver + 100%)
3. You sell a print with exclusive rights to reproduce and distribute. (1 above + 200%)
4. You sell the finished product for exclusive future sale and distribution. Exclusive is to mean no one else will print, or distribute your work. (What you believe you could earn from the image over a lifetime).
Once you elect any of the above, you give away any future financial rights to the image.
You can sell, or give, any digital file for a price to cover all future earning power from that image file. The new owner then has to recover his costs in acquiring your work product.
Do not ever give away all exclusive rights to your work, not even personal marketing rights, or promotional rights. You can sell the rights to exclusively reproduce and sell your work, but it is imperative that you keep the rights to market yourself.

If the buyer cannot agree to the above, thank them for their interest, and walk away. In a day or so offer them a slightly different option. You sell a digital print for 1 above + 30%, with the provision the print owner display the product within their domain with a credit line listing you as the owner of the image).

Since we're talking about real money here, I would strongly recommend that you contact a solicitor specializing in IPR (Intellectual Property Rights), particularly photography.

To protect yourself, you must craft the licensing agreement (NEVER SELL IT OUTRIGHT!) with the 'customer' so that you get a reasonable price for your efforts. And prevent the 'customer' from using it outside the agreed upon parameters.

Here in the states, it's not unheard of to get $10,000 US for unlimited/exclusive use of an image.

Nanaval, many of us here are well schooled in USA copyright laws, and some international laws prevail. BUT the UK has an odd way of doing things and establishing an artist's rights may be one of those subjects where they get everything backward. I suggest you do some extensive investigation on-line.

Talk to your insurance agent first. Personal insurance, homeowners, floaters, usually EXCLUES equipment used for business. A sale is a business transaction - one time, maybe OK, but talk to your agent. You could end up with no insurance.

Point of reference - a homeowners policy insures personal property. Camera equipment is personal property, insured anywhere in the world.

what is the new training provider , training you in . I take it that it has something to do with your eyes . I'm just guessing here but do they want a poster of you with your new orb. for a advertisement . for glass eyes , or medical information . and do you sell many of your pictures .

Many of the replies here seem to me to be beyond credible. The people naval is dealing with aren't going to be paying those amounts.

this goes on all the time , when some one ask what should I charge , they
go completely nuts . as if the camera is the path to riches , well I got news for them . she is not or he is not going to make two cents , on this . they seem to
think that because they get some one intestered In a pic . that there is no limit what they can get . there is sites on the Internet where you can look at
millions not hundereds but millions of pic . and there all for sale from 10 cents
to 40 ,50 , 60 cents . it would take you weeks to go through them all , you can send them pic , for there files . and if any one picks yours for use , you get two or three cents , and they get the rest on a ten cent photo , I sent them about 500 and I get a check in the mail every couple months for $1.20 or less .

Question: Do you experience this problem with one company or with a large number of similar companies?
