Copyright question?

Actually, the questions here are quite easy. Regardless of who actually owns the camera or memory cards, and lacking any express agreement/relationship to the contrary, the author/artist of the work owns the copyright. If two or more people jointly create the work, and lacking any express agreement/relationship to the contrary, they are co-owners of the work.

The agreement/relationship situations would be in the form of an employer/employee relationship, work for hire, commissioned/contractual work, or ownership transfer, and it has to be documented in the form of a written instrument signed by all parties for it to hold any weight in a court.

Of course, keep in mind, if the work isn't going to be registered, the whole question of "who owns it" is kind a pointless.

Note that LA-Shooter said "USUALLY". Your case is one of the exceptions, sort of.

You are right "USUALLY" is the key word here.

The answer to almost any question, certainly in photography, starts with "it depends...". :-)

Imagine this, a photographer, sets up his camera and with his memory card on a landscape and for whatever reason has Joe push the button. Then the photographer packs up the equipment and leaves, not showing the photo to anybody. How does Joe have a right to the photo, or sue the photographer for something he has never been in possession of or even seen? Are you saying the photographer is obligated to give Joe the memory card, or the file or print the picture for him. Or if the photographer does none of the above could Joe sue the photographer for deleting the file? How does Joe know or prove exactly the photo he see later somewhere is his, if he has never even seen the product. My camera, my memory, card my intellectual set up, my photo! Joe never owned anything or lost anything (except the court case).

You are getting into tricky and exotic hypotheticals. If you want an even more exotic hypothetical, consider a wildlife photographer who sets up a camera near a salt block, with a light beam or pressure plate trigger. Deer comes along, triggers the camera, the photo is taken. Does Bambi have copyright in the photo? After all, Bambi "took" the photo.
