Andrew Peter Napolitano (born June 6, 1950) is the Senior Judicial Analyst for Fox News Channel, commenting on legal news and trials, and is a syndicated columnist whose work appears in numerous publications, such as Fox News, The Washington Times, and Reason. Having served as a New Jersey Superior Court Judge, he now teaches constitutional law as a Distinguished Professor at Brooklyn Law School. Early life and judicial and academic career

Napolitano was born in Newark, New Jersey. He is a graduate of Princeton University and Notre Dame Law School. He was admitted to the New Jersey State Bar Association in 1975.[3] After law school, Napolitano entered private practice as a litigator. Napolitano first taught law for a brief period in 1980–1981 at Delaware Law School (then-Widener). Napolitano sat on the New Jersey bench from 1987 to 1995, becoming the state's youngest then-sitting Superior Court judge.

As a judge, Napolitano issued several notable decisions. In State v. Barcia, Napolitano found that random DWI roadblock checkpoints were unconstitutional under both the Federal and New Jersey state constitutions, and sustained a motion to suppress drug and drug paraphernalia evidence found at such a stop.[4] In the case In re K.L.F., Napolitano found that New Jersey’s Frivolous Pleading Statute could be applied against the state as well as private litigants whose claims were frivolous.[5] In Cusseaux v. Pickett, Napolitano decided that a woman who was abused and mistreated by her husband has a civil cause of action against her abuser for the resulting battered woman syndrome.[6]

He resigned his judgeship in 1995 for private practice. He later pursued a writing, teaching, and television career. He also served as an adjunct professor at Seton Hall University School of Law for 11 years from 1989–2000. Napolitano is a distinguished visiting professor at Brooklyn Law School where he teaches courses on advanced and introductory constitutional law and jurisprudence, and has begun a renewed endeavor to developing his natural law jurisprudence.

Before joining Fox as a news analyst, Napolitano was the presiding judge for the first season of Twentieth Television's syndicated court show Power of Attorney (2000–02), in which people brought small-claims disputes to a televised courtroom. Differing from similar formats, the plaintiffs and defendants were represented pro bono by famous attorneys. Napolitano departed the series after its first season.

From 2006 to 2010, Napolitano co-hosted a talk radio show on Fox News Radio with Brian Kilmeade titled Brian and the Judge. Napolitano hosted a libertarian talk show called Freedom Watch that aired daily, with new episodes on weekdays, on Fox Business Channel. Frequent guests on Freedom Watch were Congressman Ron Paul and Lew Rockwell. Napolitano has promoted the works of Friedrich Hayek and Ludwig von Mises on his program. The show originally aired once a week, every Wednesday at 2:00 p.m. on Fox News' Strategy Room.
On September 14, 2009, it became a show that aired three to four times a week. On June 12, 2010, it debuted as a weekly show on Fox Business. The show was one of several programs dropped in February 2012, when FBN revamped its entire primetime lineup.[7]

Napolitano regularly substituted for television host Glenn Beck when Beck was absent from his program. After Beck announced that he would be leaving Fox News, he asked Napolitano to replace him.[8] Napolitano regularly provides legal analysis on top rated shows both Fox News Channel and Fox Business Network, such as The Kelly File, The O’Reilly Factor, Varney & Co., The Fox Report with Shepard Smith, Fox & Friends, and Special Report with Bret Baier.

Napolitano is a well-known libertarian who is a strong advocate of constitutional protections against government encroachment on natural and legal rights, as well as a strong advocate of broad constitutional liberties themselves. Napolitano has demonstrated affinity for many libertarian thinkers, such as John Locke, Friedrich Hayek, Murray Rothbard, Robert Nozick, Randy Barnett, Ayn Rand, and Ludwig von Mises, and a broad array of libertarian ideas aimed at a minimal state aimed at the preservation of personal liberty. Napolitano is noted for stalwartly disagreeing with conservatives on questions of personal freedom, national security, and equality, while also engaging in full-throated defense of more conservative ideas of economic freedom and scope of government.

Napolitano describes himself as pro-life and holds that abortion "should be prohibited."[9] He reasons while a woman has a natural and undeniable right to privacy in her personal choices, the rule of necessity causes the right to life of the fetus, which he believes to begin at conception, to take priority for the duration of gestation. Napolitano believes the Supreme Court's ruling on inter-racial marriage in the 1967 case Loving v. Virginia set a precedent that would also require state recognition of same-sex marriage.[10] He also opposes capital punishment: "I don't believe that the state has the moral authority to execute."[11] Napolitano is also a believer in the separation of Church and State.

With respect to both Presidents Bush and Obama and their handling of civil liberties in the War on Terror, Napolitano is a strong critic. In both his recent scholarly work, appearing in the New York University Law School Journal of Law and Liberty, and in his book Suicide Pact, Napolitano delivered detailed criticisms of the actions of both Presidents and their parties with respect to torture, domestic spying, unilateral executive action, and encroachments on political power.

Two weeks after a segment on Geraldo Rivera’s program in 2010 about how the collapse of the 7 World Trade Center appeared more consistent with controlled demolition than collapse, Napolitano made comments on the Alex Jones show that have been interpreted as sympathetic to 9/11 truthers.[12] The extent to which his statements expressed sympathy with those who were skeptical of the events, finding them “hard to believe” because of Geraldo’s program, rather than acceptance of a conspiracy theory, has been a topic of debate.[13] His most extensive work on the topic of 9/11, Suicide Pact, does not express any sympathy with the position, nor have any of his public statements since.[original research?]

Napolitano believes that President Obama’s recent Executive Order on immigration is an unconstitutional use of executive power. He argues that as the president’s exercise of prosecutorial discretion is directly opposite to the will of the United States Congress, it cannot be sustained as an exercise of prosecutorial discretion pursuant to an act of Congress, but rather is an independent presidential act.

Judge Napolitano ascribes to a natural law jurisprudence that is influenced with a respect for originalist ideas and method. He has expressed strong sympathies with the Randy Barnett new originalist vein of originalism, as it incorporates the Natural Law through an original understanding of the Ninth Amendment. He has published a favorable column on Barnett’s idea of a constitutional presumption of liberty.[15] While Napolitano’s academic work as of late has tended to focus on issue-specific concerns of the Natural Law and rights,[16] he aims to more fully develop a jurisprudential theory around his conception of the demands of the Natural Law.

Napolitano’s philosophy generally has a strong originalist bent, while not accepting the limitations of the older types of originalism espoused by Robert Bork and Justice Antonin Scalia with respect to the Constitution’s open-ended provisions like the Ninth Amendment. Napolitano finds such limitations too restricting on a judge’s ability to apply the Natural Law to decide cases where the liberty of the individual is at stake. Napolitano is a strong believer in economic liberties and argues that the decision Lochner v. New York was overruled in error in the West Cost Hotel case, as the Contracts Clause and the Fifth and Fourteenth Amendment Due Process clauses protect a sphere of personal economic liberty.[17

Napolitano’s Natural Law jurisprudence incorporates some Living Constitutionalist decisions, such as Brown v. Board of Education and Loving v. Virginia as proper expressions of the Natural Law in terms of personal autonomy and equality. While not ascribing necessarily the reasoning underlying the Supreme Court’s decisions in the area, Napolitano finds that there is a natural right to privacy.

Napolitano’s recent academic and popular work has work asserted that, similar to Randy Barnett’s presumption of liberty, there is a bias in favor of freedom incorporated into the Constitution for when courts are faced with a question of liberty versus security.

In September 2015, Napolitano was the featured speaker at a conference held by the conservative, government watch-dog group Judicial Watch.[18]

There is trouble in Hillaryland: According to anonymous sources who spoke with Politico, Hillary Clinton is frustrated with her campaign staff — and vice versa. With the too-close-for-comfort win over Bernie Sanders in Iowa and a New Hampshire victory for the Vermont senator on the horizon, Clinton is reportedly looking to reassess the staff at her Brooklyn headquarters sooner rather than later.

One source who is close with both Hillary and her husband, former President Bill Clinton, said, "The Clintons are not happy, and have been letting all of us know that. The idea is that we need a more forward-looking message, for the primary — but also for the general election too… There's no sense of panic, but there is an urgency to fix these problems right now."

There is dissatisfaction among Clinton's staffers, too:

Over the summer while her campaign was bogged down in the email controversy, Clinton was deeply frustrated with her own staff, and vice versa. The candidate blamed her team for not getting her out of the mess quickly, and her team blamed Clinton for being stubbornly unwilling to take the advice of campaign chairman John Podesta and others to apologize, turn over her server, and move on. The entire experience made her a deeply vulnerable frontrunner out of the gate, and underscored a lack of trust between Clinton and her operatives, many of whom were former Obama staffers that she didn't consider part of her inner circle of trust.

Her advisers were also frustrated by having to play roles they hadn't been hired for and were ill-suited for. From the beginning, [the campaign's top pollster and strategist Joel] Benenson was frustrated that he was forced to split his time between defending his boss on emails and defining a path for her candidacy. Clinton, meanwhile, longed for a chief strategist in the Mark Penn mold who could take on a more expansive role than playing pollster.

We have quite a few pileated woodpeckers where I live, we hear them "drumming" almost daily, but I'm lucky if I actually see one once a month!

For as big as they are, pileated woodpeckers have an uncanny ability for avoiding humans. Sometimes when I have a bunch of feeders in my back yard filled up with sunflower seeds, peanut butter, niger and shelled corn, it's common to have red-head wood peckers, downy wood peckers, red-belly wood peckers, and hairy wood peckers all enjoying the "hand-outs" at the same time, and on one or two rare occasions I've seen a pileated stop by, perch for maybe a minute in the very top of a big beech tree, check out all the other birds, then fly off to the woods across the road. Not once have I ever seen a pileated ever come near one of our feeders; pileated wood peckers go almost exclusively for large grubs and large insects, and they'll literally tear a dead or rotten tree to pieces to find the big juicy grubs that they like.

I have probably walked 100 miles in the woods nearby in the spring, over the last few years, hoping to find a pair of pileated wood peckers nesting; so far I've found quite a few red-heads nesting, (my 2nd favorite wood pecker), we have an eagle nest not too far away that the same pair of bald eagles nest in ever year for 15 years now, but to date, I have yet to find pileated wood peckers nesting.

Why should the American public be concerned about Hillary Clinton’s email scandal?

Judge Andrew Napolitano pulled no punches when he gave Judge Jeanine Pirro his take on Saturday.

“Because she wants to be the president of the United States, and she’s a felon,” he said plainly.

Judge Napolitano sat down on Justice on Saturday to weigh the dangers of a potential President Hillary Clinton.

Clinton’s emails “are important, because they show the manner and methods by which the United States government acquires foreign intelligence,” he explained.

Judge Napolitano said that Clinton “has shown a cavalier attitude about preserving these secrets,” as well as the names of “people, who if their names came out, would be dead.”

This “violates an oath she took when she became Secretary of State, which violates the same federal criminal statute that was used to prosecute General Petraeus,” he said.

“She should be indicted for it.”

The State Department has deemed that 22 of Hillary Clinton’s emails are "too damaging" to national security to release under any circumstances

Fox News chief intelligence correspondent Catherine Herridge now reports this morning that the emails contain “operational intelligence” and their presence on the unsecure, personal email system jeopardized “sources, methods and lives."


Judge Andrew Napolitano discussed the new developments with Stuart Varney this morning, explaining that the latest report reveals a new twist in the scandal.

He said that up until now, the State Department has been agreeing with Clinton's repeated assertions that she never sent or received emails "marked classified."

The State Department is now disagreeing with the former secretary of state, he said.

"They're saying, 'We, the State Department, found 22 top-secret emails, highest category,'" said Napolitano.

"Not only were they top-secret, they were operational. ... They were characterizing and they were about intelligence projects that were going on as the emails were being written," he pointed out.

Clinton has recently claimed that the email scandal is similar to Benghazi, with Republicans trying to damage her politically.

SF cops admit car-theft victim was wrongly turned over to ICE

San Francisco police officers handcuffed a car-theft victim, ran his name for warrants and then released him into the waiting arms of federal immigration agents, records show, in what is being investigated as a possible breach of local sanctuary-city laws.

Pedro Figueroa-Zarceno, 31, was released from jail Wednesday after two months and spoke at a news conference Friday. Afterward, Police Chief Greg Suhr acknowledged that the longtime city resident never should have ended up in the custody of immigration agents.

Police officials did not specifically admit to calling those agents, but federal officials said police had done just that.

“We are happy and relieved that Mr. Figueroa-Zarceno has been restored to his family,” said Sgt. Michael Andraychak, a police spokesman, in a statement.

“It is the policy of the San Francisco Police Department to foster trust and cooperation with all people of the city and to encourage them to communicate with SFPD officers without fear of inquiry regarding their immigration status,” Andraychak said. “We are aware of concerns this incident has raised with some members of our community.”

He said the police force had opened an internal affairs investigation to determine whether any officers should be disciplined.

Deportation order

The incident raised questions about how San Francisco authorities interact with immigration agents. The controversy flared last year after the Pier 14 killing of Kathryn Steinle by a Mexican national who was facing deportation but had been freed from San Francisco jail under the sanctuary-city laws.

Federal officials said Figueroa-Zarceno was the subject of a deportation order arising from his failure to appear at an immigration hearing in San Antonio in December 2005, and from a 2012 conviction for drunken driving.

But Figueroa-Zarceno’s attorney and San Francisco Supervisor John Avalos said the police cooperation with immigration authorities violated the city’s sanctuary-city ordinance that bars any use of money or resources to “assist in the enforcement of federal immigration law” — an ordinance designed in part to make potential crime victims and witnesses feel comfortable working with authorities regardless of their immigration status.

As San Francisco officials work to clarify policies in the wake of the Pier 14 case, immigration advocates say Figueroa-Zarceno’s detention is an example of a broken immigration system — and yet another reason why San Francisco needs to strengthen its policies.

Make policy ‘stronger’

“We want to make sure that as the sanctuary policy is politicized by what’s happening on a national level, that we can protect it and make it stronger and make sure that people like Pedro do not get impacted,” Avalos said.

Figueroa-Zarceno, a Mission District resident, had reported his car stolen in November. Then, on Dec. 2, he received word from the police that they had found it. But when he went to the Southern Police Station on Third Street to get the police report, he said he found himself in handcuffs.

According to a report from the U.S. Department of Homeland Security, which oversees immigration, San Francisco police ran a routine background check on Figueroa-Zarceno and discovered that he had an outstanding warrant out for his deportation from more than 10 years ago.

Eileen Hirst, chief of staff for the San Francisco Sheriff’s Department, said police officers contacted her department’s central warrant bureau, whose job it is to confirm warrants.

She said deputies contacted the service center at the U.S. Immigration and Customs Enforcement and confirmed the warrant. The deputies relayed the information to police, who had authority to decide whether to honor the warrant, Hirst said. The Homeland Security report said an ICE duty officer was informed of Figueroa-Zarceno’s whereabouts by both the service center and San Francisco police.

Back at the station, “I was handcuffed because they told me there were questions they needed to ask me, but there were no questions asked — I was simply handcuffed for about 15 minutes,” Figueroa-Zarceno said Friday.

ICE was waiting

“I was happy that they told me they were going to release me,” he said, “but once I got out of the Police Department, there was ICE outside.”

As his 8-year-old daughter screamed, “Papi! Papi!” and begged federal agents not to take him, Figueroa-Zarceno was shackled, put in a van and driven to a Contra Costa County jail where ICE houses inmates. He was released Wednesday on bail.

ICE officials said Friday that Figueroa-Zarceno is one of the “at-large foreign nationals who meet the agency’s enforcement priorities, including convicted criminals and other individuals who pose a potential threat to public safety.”

“Mr. Zarceno-Figueroa’s case is now being reviewed by the immigration courts to determine whether he has a legal basis to remain in the U.S.,” said James Schwab, an ICE spokesman, in a written statement.

Figueroa-Zarceno says he never defied immigration authorities. He came into contact with ICE shortly after he entered the country and explained he planned to file for asylum from the violence in El Salvador, said his attorney, Zachary Nightingale.

Aunt in San Francisco

He told the agents he planned to go to San Francisco, where his aunt lived, but still intended to go through the hearing process, Nightingale said. He said his client provided his aunt’s address in San Francisco, but never heard from authorities.

“That is not uncommon in my practice to see people whose cases go off the rails for reasons that are not their fault,” Nightingale said. “To me, this clearly indicates why San Francisco should not just be turning people over blindly to ICE.”

The question of whether notifying ICE of a person’s immigration status constitutes a violation of sanctuary-city laws was fiercely debated following the Pier 14 killing. A month before the suspect in that case was released, then-Sheriff Ross Mirkarimi issued a memo banning all communication with immigration agents seeking to deport jailed suspects, absent a warrant or court order.

New sheriff, new view

Newly elected Sheriff Vicki Hennessy is working to reverse that order to allow for some cooperation with federal agents in the most serious criminal cases, a move that has been criticized by advocates for immigrants.

Christine Falvey, a spokeswoman for Mayor Ed Lee, said Friday that the mayor remains “a firm supporter of the sanctuary-city policies.” After Suhr alerted him of Figueroa-Zarceno’s case, the mayor reached out to the Homeland Security secretary, she said.

“He expects the chief to fully review this case to make sure this doesn’t happen again, and the chief has assured a thorough review will happen as soon as possible,” Falvey said.

Obama Says Mosque With Extremist Ties Has ‘An All-American Story’

President Obama met behind closed doors on Wednesday with 13 Muslim leaders at a Baltimore mosque with ties to the Muslim Brotherhood. And, according to a White House pool report, one of the participants is the Islamic Society of Baltimore’s anti-gay resident scholar, Imam Yaseen Shaikh.

Obama’s short trip to the Islamic Society of Baltimore (ISB) marks his first visit to a U.S. mosque since taking office. After the meeting Obama spoke to congregants at the mosque, which he said “like so many in this country, is an All-American story.”

Introduced by ISB’s president, Muhammad Jameel, who in 2014 accused Israel of engaging in “genocide” against Palestine, praised the mosque for its inter-faith outreach efforts. He also praised the mosque’s school, “where teachers open young minds.”

But ISB’s schools, the Al-Rahma School and Qur’an Academy, are led by Imam Shaikh, a British citizen who formerly served as imam in Plano, Tex., who has said that Islam is adamantly opposed to homosexuality.



A 2013 YouTube video uncovered by The Daily Caller also shows Shaikh lamenting that gay rights activists have “hijacked” the political system to further their agenda. (RELATED: The US Mosque Obama Has Chosen For His First Visit Has Deep Extremist Ties)

“This whole subject of homosexuality in the public sphere…is no longer a religious issue, unfortunately, as much as we want to use the religious card and try to defeat this, now it’s become a politicized issue,” Shaikh said in the hour-long sermon.

“Politicians are highly influenced by people who back them, and we find that these politicians who are calling for gay rights and marriage and supporting gay rights are lobbied and campaigned by gay activists, by gay groups. And they are throwing money at it left and right to gain some acceptance in society, to be considered normal people, to be treated normally.”

Shaikh also warned that children must be taught that homosexuality is “not okay.”

“We have to counter the efforts that are taking place elsewhere,” Shaikh says in the video, adding that “if our children are taught that [homosexuality is] okay, we have to teach them it’s not okay.”

But ISB’s extremist ties runs deeper than its relationship with Shaikh.

The mosque is also a member of the Islamic Society of North America (ISNA) network. That organization has long-standing ties to the Muslim Brotherhood and was named an unindicted co-conspirator in the 2008 Holy Land Foundation terror financing case. Five executives with the Foundation were convicted of funneling money to the terrorist group Hamas, which is the Palestianian wing of the Muslim Brotherhood.

The mosque’s imam for much of the 1980s and 1990s also has close ties to extremists and terrorist groups.

Mohammed Adam el-Sheikh was a member of the Muslim Brotherhood in Sudan, his home country, in the 1970s. He also co-founded the Muslim American Society, which is controlled by the Muslim Brotherhood.

While in Baltimore, el-Sheikh served as a regional director at the Islamic American Relief Agency, which the Treasury Department designated as a terrorist organization in 2004. The organization’s African arm reportedly funneled money to al-Qaeda, Osama bin Laden and other terrorists.

After leaving ISB in 2003, el-Sheikh served as imam at Dar al-Hijrah in Falls Church, Va. That mosque has numerous links to terrorists and terror sympathizers. Before el-Sheikh’s tenure, Dar al-Hijrah’s imam was Anwar al-Awlaki, the al-Qaeda recruiter killed in a U.S. drone strike in Yemen in 2011.

In 2004, el-Sheikh defended Hamas’ use of suicide bombers against Israelis.

“If certain Muslims are to be cornered where they cannot defend themselves, except through these kinds of means, and their local religious leaders issued fatwas to permit that, then it becomes acceptable as an exceptional rule, but should not be taken as a principle,” he said in 2004, according to a Washington Post article at the time.

Another one of the 13 roundtable attendees on Wednesday has espoused extremist, anti-Israeli rhetoric.

Rami Nashashibi, the executive director of the Chicago-based Inner-City Muslim Action Network, has gone on record supporting a movement to sanction and boycott Israeli companies and scientists. During a May 2015 speech supporting that movement, known as the Boycott, Divestment, Sanctions movement, Nashashibi asserted that Israel’s treatment of Palestinians in disputed territories is a form of “apartheid.”

Obama did not address any of the issues backed by ISB officials and some of his roundtable attendees. Instead, he sought to portray Islam as a religion of peace and offered thanks to American Muslims.
“So the first thing I want to say is two words that Muslim Americans don’t hear enough — thank you,” Obama said during his speech.

He also expressed sympathy over what he said is a spike in anti-Muslim bias.

“On top of that, as Muslim Americans, you also have another concern. And that is your entire community is targeted or blamed for the violent acts of a few,” Obama said.

More recently, Grace Vuoto of the World Tribune reported that among the experts challenging the birth certificate is certified document analyst Reed Hayes, who has served as an expert for Perkins Coie, the law firm that has been defending Obama in eligibility cases. "We have obtained an affidavit from a certified document analyzer, Reed Hayes, that states the document is a 100 percent forgery, no doubt about it," Zullo told the World Tribune. "Mr. Obama's operatives cannot discredit [Hayes]," the investigator told the news outlet. "Mr. Hayes has been used as the firm's reliable expert. The very firm the president is using to defend him on the birth certificate case has used Mr. Hayes in their cases." The Tribune reported Hayes agreed to take a look at the documentation and called almost immediately.

In my opinion, the birth certificate is entirely fabricated," he says in the report.

Investigator Douglas J. Hagmann of the Northeast Intelligence Network reported this month that in October an affidavit was filed in a court case, under seal, that purportedly identifies the creator of the Obama birth certificate. He said Douglas Vogt, an author and the owner and operator of a scanning business who also has an accounting background, invested over two years in an investigation of the authenticity of document. Vogt, along with veteran typesetter Paul Ivey, conducted "exhaustive research of the document provided to the White House Press Corps on April 27, 2011 – not the online PDF, a critical distinction that must be understood," Hagmann said.

"Using their combined experience of 80 years in this realm, they conducted extensive examinations of the 'copy' that was used as the basis for the PDF document. They acquired the same type of equipment that was used back in the late 1950s and early 1960s in an attempt to recreate the document presented as an 'authenticated copy' proving the legitimacy of Barack Obama. Instead, they found 20 points of forgery on that document and detail each point of forgery in the affidavit," wrote Hagmann.


Gitzo says;
