Push this just a little and if a parent decides to let go of their embryos, and you have multiple murder in the first degree. Then if anything happens you have causing death by negligence...

Potential parent are suing because of a hospital mishaps that led to the destruction of their embryos.

If this is moronic decision is held, I hope someone will sue the parents for child abuse since they kept them frozen in time. Then there is the issue of child abandonment to a third party.

I'm a little perplexed why you think this is a moronic decision. The "parents" undoubtably paid thousands of dollars to a fertility clinic for those frozen embryos.

You have no idea what the costs were to the individuals who sued nor do you know if they are capable of ever having another chance to have children.

Its perfectly possible that those embryos were frozen because one of them was about to undergo a medical procedure that would make them sterile and unable to have children in the future without the embryos.

How would you like it if someone screwed up and took away your chance to have children. Should you not be compensated for that?

I have no beef with the parents asking for damages. I have a beef with judges that find the embryos being 'persons'. That is where the issue really is.

The judgment opens the door to all types of abuse.

The current exchange does not reflect any of them.

Chief Justice Tom Parker issued a concurring opinion that quoted the Bible as he discussed the meaning of the phrase “the sanctity of unborn life” in the Alabama Constitution.

“Even before birth, all human beings bear the image of God, and their lives cannot be destroyed without effacing his glory," Parker said.

Justice Greg Cook, who filed the only full dissent to the majority opinion, said the 1872 law did not define “minor child" and was being stretched from the original intent to cover frozen embryos.


As to using the bible instead of the law??? Wow!

Yes, life is sacred, from conception. However, the 1872 law does come into effect. They're not just basing their ruling on Holy Writ but established law as well. It's nice when they coincide. So, don't get your nose out of joint because the justices are Christian and voiced that belief. Get upset if they were wrong on the law. In this case they were not and you didn't question their interpretation of the law, either.
