Should I get paid for this?

My approach would be a little different. I would explain that any photos published would reflect on my abilities as a photographer. Although, these are good photos, I know I can do better. This would profit everyoone concerned. What kind of arrangements can we make to get the photos that will sell, homes and memberships?

I would offer 1, maybe 2, I took without permission and generate some excitement for a whole new photo shoot, and then talk price. This way you are still friends with everyone and your profit margin will be much greater in the future.

The important things are your making sure they know you retain the copy write to each image, they must give you credit for the images on brochures or however their planned usage, they are not allowed to sell your images without your permission, and that you are paid, in whatever form/ammout of your agreement.

Good for you, and congratulations on getting your name/photos out there by giving them away!! I love to give photos away to folks who appreciate them.

Here's the facts (sorry its a little lengthy).

1. I am an amateur photog. Have done a few weddings for nieces to cut them a break, but never charged them.

2. Now retired, I have thought of making my photography a sideline business on a limited scale to make a few bucks.

3. I am a member of a small Golf club, and have taken a number of very nice pictures of some of the more picturesque area of the course. I have given some of these as gifts to other members.

Now, the issue...

The Club's management called me and said a local, prominent real estate Broker called them and asked for a few nice pictures of the club, that he could use in marketing golf course homes. The payoff for the Club is that the Broker would encourage them to join the club (and pay dues, etc.)

The thing is, the Club doesn't have any nice pictures, but they know that I do, and have asked me to send some pictures to them, that they can forward to the Broker (who is also a member of the Club by the way, although I don't know them personally).

I was a little flattered, but then got to thinking that everybody but me stands to get a little moolah out of that arrangement!

So, the question is.....

Do I just give these pictures away to a millionaire real estate broker because the Club asked me to? I never asked permission to take the pictures of the Golf Course, so do I have the right to charge a 3rd party (Broker), for the images?

Thoughts, Opinions?

A whole new question would be, if so.....how much $?

Thanks team!
Here's the facts (sorry its a little lengthy). br ... (show quote)

Absolutely...I would ask for a free membership for a year or two or more depending on how much it cost per year...but a word of caution would be...dont be too pushy cause as everyone here knows...everyone has a camera and EVERYONE takes great shots...

I would bring some small 4x6 prints to the meeting for a little show and tell. Then just see where the talks lead. They might have an offer in mind and seeing the pictures might help them decide. At the very least, they should offer a free membership or %50 off for life or something like that.

Too many artifacts at the merge line - and it is a boring single color sky. These things are almost always better shot correctly rather than having skies dropped in.
90% of good landscape shots are done in the first and last hours of the day.

Your shot shown would look a little out of place with a blue sky and clouds inserted as suggested, only because there are no hard shadows, so it would look obvious that someone photoshopped the image. Better to add a blended high cloud with soft blue showing through to give a better feel of reality.

People often rush to add sky without giving thought to what is being shown in the image itself. Always remember to look at the image then determine what type of sky would best complement that image, not just throw any type of sky into a scene, that would be the mark of a beginner.

As for your problem, I'd suggest you tell the club, you'd be happy to put some images together for the real estate people to look through. Then when you do it, have your water mark through them and a note to say that these are example images for them to determine which ones they may like to purchase and state that you'd be happy to come to their office and show the full clean image on your laptop for them to get a more accurate image to choose from. Then give them a list of ways they can purchase from outright to licensing the image. Also include a list of your hourly or job rates, should they require any other images taken, there or anywhere else.

Your club doesn't seem to have a problem with using your photos for commercial purposes, and the same goes for the Realtor. So my question is, why should you be the exception?

Yes you should be paid. If you've ever been to a portrait studion you'll, in most cases, see a copyright on the final pictures - there's of course a reason for this.

So, my suggestion, make sure the club understands these photos are copyrighted in your name and charge them a reasonable fee for each one.

If they want more the same deal goes.

Best of luck.

I agree with the captain, before even seeing the artifacts, your new sky looked fake, unreal, my attention was drawn to the unlikelihood of a natural sky rather to the main subject matter. Your photo will be worth as much to others as they paid for it. To let them have it for nothing, will be worth just that to them.

Yes, charge them (or at least get something for your golf, assuming you play). And get a credit line, you're entitled to it for their use of your copyrighted photos.

I've done some photographing on the side since I retired and in most cases, with people you have relationships with I find it best to barter at the begining and if it works out for a long term relationship (with the real estate co.) then costs can come into the picture..Good Luck

Never give your work away, if you are considering doing this as a professional. Think about what you have invested so far. Your time (including your travel time), camera, printer, paper, any advertising (including word of mouth.)

If you don't charge for this, get a least get a membership paid for as long as you are providing them the photographs.

Remember this: Don't refer them as pictures. They are photographs.

Good Luck.
