Great photo! Still would like to see your 2nd place winner and the others the bank is interested in. Again, however, if any of the photos the bank wants were submitted, they don't have to pay you anything since you already gave them a non-exclusive right to use. So if they are willing to pay you even $25 for each of those, take the money and run. And, as for letting them use this photo that you did not enter in the contest, as long as you are only giving them a non-exclusive right to use it, why not take the $25? You can still sell it to others for whatever amount you want. I sold a photo (attached) with a non-exclusive license to our favorite patio bar/restaurant in Scottsdale for them to use for postcards and a magazine ad, for a $100 gift certificate. Just be sure to watermark it with your name and copyright notice (the "C" inside a circle), which you can do regardless of whether you register it with the US Copyright Office. Just so you know everyone has a common-law copyright on an original work of art regardless of whether it's registered, but let's not go into that discussion again.

Thank you Lou, yours is great as well. My concern was whether I would still be able to sell copies of this or any other photo if I sold it to the bank, so thank you for answering that question. I'd like to thank everyone who provided valuable input to my question. Still debating about posting my photos on this website, because sadly, I know people that have had their work stolen by posting it online. Hesitated to even post the above picture. I had that one with me because I had just printed an 8x10. (It is one of the ones the bank wants to buy.)

The OP did not give away the copyright. The bank has the right to NONEXCLUSIVE use of the photos. There is nothing there about giving up the copyright. And since the bank has the right to use the photos and is willing to pay for using one, the OP doesn't have much negotiating power beyond taking what they offer or asking to more hoping they will be extra generous.

Just a quick update. Met with the VP of Marketing on Monday to pick up my check. Turns out the bank is the one who sponsored the contest. Marketing guy looked at my other photos and is interested in purchasing digital copies of 2 other photos for their website and brochures. Bubble was burst when he only offered $25 for each photo. Said he usually uses stock photos and pays $10 for those, but preferred local pictures that our community can identify with. Told him I'd sleep on it and get back with him-haven't yet. I'm still having computer problems and just made a quick pit stop at the library to check my email. Don't have photos with me as some requested, other than one of the ones he wants to buy that wasn't submitted in the contest (see below). Not sure if I want to give up exclusive rights for only $25.

Sorry for the delay in getting back with all of you, my computer froze up on Sat. and I was busy yesterday. Wow, I didn't expect so many replies. Thanks to all (except one) who were kind enough to respond-it's a lot of food for thought. To sum things up, yes, I was aware of the permission rights when I entered the contest. I hesitated entering for that reason, but decided to enter some photos that were good, just not my best ones in the event they didn't win-I didn't want to give away my rights. The photo that they want to purchase WAS submitted in the contest, but they have asked to purchase it from me. Not sure if the contest is sponsored by the bank or someone else, I am meeting the gentleman at the bank this afternoon to pick up contest $ and discuss the photo he wants to purchase. He also told me he'd like to look at some of the other photos I have that I didn't submit. I do not have a photography business and this is the first photo contest I won $$ in. (I've only entered a few but I did win an "honorable mention" in a photo contest that was judged by a former student of Ansel Adams). I consider myself an amateur, yet when I submitted some of my photos to the Director of Public Relations of a large Zoo she said "You're no amateur-these look like professional photographs". Yet I still have so much to learn, and UHH is a great learning place! That said, I asked what would be a fair price for the second photo entered in the contest just to get a ballpark figure. I think I will be happy with what they offer, based on their prize $$, as this was an unexpected surprise.

Sounds like you gave away your rights by submitting that image for the contest. If the bank want's to play hardball, they don't have to pay you anything. That is exactly what "royalty-free, perpetual, non-exclusive license to display and distribute the entries in any media format, including use for any XXXX related marketing and promotional purposes" means.

If they are being generous, I would suggest what the second prize was - and be happy to get that.

Thank you Gene, I purposely didn't submit my best pictures because I didn't want to give away my rights. I'll be happy with whatever they offer.

Hello All, I haven't posted on UHH for awhile, although I frequently read the discussion board and view photographs. I'm hoping someone can provide some guidelines in the pricing of a photograph of mine that a bank wants to purchase. I recently won a photo contest (2nd runner up) with a prize of $200. Yeah! I will be meeting with the bank rep on Monday to pick up the check, have my photo taken and sign forms. The bank rep indicated that he wants to purchase another one of my photos that I entered in the contest (yeah again!), and said we could discuss pricing when I meet him at the bank on Monday. The will be using the photos for promotional purposes (the contest involved submitting photos that capture the beauty of our area and show why its a great place to live). So my question is, what is a fair price to ask for my photo? I'm including some verbiage that was listed in submitting photos for the contest:

•All contest participants will agree that "Any photograph submitted for this contest must be taken by the person entering the contest. Submission of a photograph grants XXXXX a royalty-free, perpetual, non-exclusive license to display and distribute the entries in any media format, including use for any XXXX related marketing and promotional purposes.

Remember to draw a little diagram so you know which is which.
I'm setting an alarm so I can see it and an Atlas V go off at Vandenberg AFB.

Thank you Craig, caught it this morning (not the Atlas V unfortunately).

Sonny, thanks for your response. That's a great website. My pics were taken about a week ago during the time of the eclipse/blood moon. I am new to all of this. Do you know if the star/planet lineup would still have been the same at that time?

I've seen good reviews on this Canon so don't dismiss based on a few photos that didn't come out the way you wanted. Much of shooting Astrophotography is technique and that takes practice.

Keep trying and follow the advise you get. Its the cheapest thing we have going here and everyone just gives it away like its Christmas.

Thank you Albuqshutterbug. Feels good to be back. Such a nice group of people in this section. By the way, I LOVE my Canon t3i. Have taken some fabulous shots with it. Just seems like my Nikon outshines it for moon shots, which surprised me. (Here's one taken not long ago.) I'm sure I'll be spending a lot of time in this forum soaking up as much info as I can.

This certainly looks like something out of focus. Only a bright planet or very bright star could do this. Venus doesn't rise until about 3:30 AM and Jupiter more than an hour after that. The brightest evening star to the east right now is Alderamin, and it is only something like 2nd magnitude. It can't be a nebula as those are quite dim. The star Sirius rises too late and is far to the south.

Just not sure what you were seeing.l.

Jim, I had no idea what I was seeing either. That's what made me return to the "hog" for advice. Glad I did.

Craig, based on all of this I guess I'll just be left wondering if it was a camera glitch. I do know that it was about 15-20x bigger and brighter than the North star, and it was in the same location where the sun rises. I initially thought it was a plane flying low because I'm in close proximity to an airport. Certainly makes me want to pursue more astrophotography. Thanks for your time.

What time of the night did you take the photos???
Craig

Hi Craig, I don't have the exif info with me right now. It was either around 8:00 pm or 11:00 pm. I live in southeast Michigan and was taking my dog outside when I noticed a very bright object in the sky. First thought it was a plane, until I noticed it wasn't moving. Went inside and grabbed my camera. Online research showed Venus was visible in that area so I wasn't sure if I got lucky capturing it.
