I'm pretty sure that's a sharp shinned hawk, they have skinner legs than the Cooper's hawk.

This hawk is a frequent visitor to my bird feeders, and as he swooped by me today, he snatched a sparrow out of my burning bush and then flew to a large maple tree two houses away so I grabbed the camera.
