We seem to be unanimous in our disagreement!

Nice shots Bernie. Couldn't help with the id beyond Hawk.

I'm going to take an unusual position and completely disagree with myself. I first ID'd this bird looking at it on my phone. Now looking at it better on my PC, I believe it is a red-shouldered hawk. The tail is way too short to be an accipiter (sharp-shinned or Cooper's). Note how far down the tail the wings reach. Accipiter tails would be longer and red-shouldered are buteos known for their longish tails. The black and white tail bands also point to red-shouldered. SS or C would have gray and black with a white terminal band. You can also just make out the black and white checkered pattern on the wings which also points to red-shouldered.
Sorry for the initial misidentification.

Definitely an adult sharp-shinned for the reasons already listed. Cooper's would have a dark cap on the head not this same colored hood going down its neck. Legs are also too thin for a Cooper's. And outer tail feathers are the same length as inner ending with a nice white terminal tail band.

It has been rainy and windy all day and most of the hood birds and come and gone, in between downpours and brief filtered sunlight. I noticed their food looked low and as I went out to refill, saw this magnificent creature in a tree in the neighbor's yard (~ 40' away). He was kind enough to wait for me to get my gear. Last week, we had a Cooper's hawk who flew in and snatched a sparrow. (He must have been hungry!) Anyway, I don't think this one looks like that one. I am sure folks here know their hawks. Somebody school me, please. Thanks!

The cross eyed Barbra Streisand look seem to fit sharpshin, too.
A male sharpshin is still my ID.

Yes, a Red-shouldered Hawk.
To reiterate my point, context is the part of the ID process that is missing from photographs. I can't count the number of times I have changed my ID when a bird calls, flies or I am simply able to move around and get a different view. Missed calls are no big thing. If you had taken the shot and seen the birds' behavior in the field your mind, or mine, would have kind of said Red-shouldered Hawk and gone on to the next issue.
