Nonsense you think there is a similarity? The graphic is unique because of the shared eye between the two individuals, that is very creative...your photo doesn't even suggest that to my brain. Instead it is just a mediocre photo of a couple hugging each other. In no way would I see your image as an inspiration for anything.

OP, I think you are grasping at straws here. Even if you flip either picture, the poses are different. Also, the tattoo is a prominent piece of the drawn pic, all yours has is an obnoxious watermark.

And poaching is unlawful hunting, so no this would not be poaching!!!!

Luke, I can't agree with you, but I understand your wanting to protect your images. First off, the image you took appears just to be a very informal snapshot, a candid image, flat lighting, not something that you spent much time creating. The art piece, though definitely not my style, is quite beautiful, something that the artist put a lot of effort into, creative, stylistic. Sure he may have seen your image somewhere, but could have just as easily seen something very similar to yours at a dozen different venues. Your work is not necessarily unique. The artist has something that is unique. I would suggest to you that you put some effort in learning about directional lighting and creative posing, then create something that is unique, and if you really want to protect that image, then go thru the copyright process. Not that expensive, but will give you a sense of security. I wish you the best of luck in your photography endeavors.
