Maggie, if you don't object, how about posting the photograph that you are referring to here upon our forum.. Once you do this, I should think that all of us will have a better perspective upon how we should look at the situation and it may better help us to make up our minds whether or not you should to anything to resolve the issue or not..

My brother-in-law was a art-director in advertising in Chicago for some time. He said that artistic thieving is rampant in the advertising community.

At the very least, the Realtors should be informed. If the picture is being sold with the house and you file any kind of claim, close of escrow could be delayed for months. At least, the Realtors should know what type of person with which they are dealing. If the sellers Realtor is aware of the situation and proceeds with the sale, he/she will have violated the NAR Ethics Code. The effect is such a seemingly trivial matter could have serious consequences. One thing- if the copyright is not registered, register in NOW!

Sometimes it's much better just to let it go. When you post your work online (Facebook or anywhere else) it is an engraved invitation for image thieves. It's analogous to dropping your purse on the street and walking away to see what happens. As you may know, many photographers use watermarks to prevent this problem. >Alan

Well, she's already ruined the relationship, as far as I'm concerned, but you have very little recourse. I'd drop her from my client list, just the same. Not out of hostility, but out of pure business sense.

To me, posting an image on FB is like putting an item out on the curb with a "Free" sign in it. Just saying.

Had she already apologised? It's unclear from your post. Since she is apparently a good client and doesn't claim your image as her own or has offered it for sale, I would just let it go. What would you reasonably hope to gain from such a confrontation, and what would you potentially lose? It's business. Don't let it get personal unless she materially hurt your business.

She recently apologized today, yes, and I accepted it- "Hey Maggie....I hope your ok with your photo on my wall. Went you posted on Facebook awhile back in had sent it to a bunch of people in know saying how much I loved it. Well one of them got it put on canvas for me. If it's any consolation whenever anyone comments on the photo I tell them you took it and let them know you our family photos too. I hope you aren't mad. I'm sorry if you are. 😕 "

If it were me I'd accept the apology and let it end there. What more could you possibly hope to gain?
