Many years ago I was involved in a lawsuit for an accident. The plaintiffs attorney was suppose to be very good. Somewhere along the line I read an article to take a small piece of paper and have it in your hand when your on the witness stand and on it write a little reassuring confidence builder. While answering the attorney's questions I would look at this piece of paper. The attorney eventually noticed this and started to question me about what I was doing and I informed him it had nothing to do with the trial. He was persistent in finding out what I had in my hand. To the point of asking the judge to demand I answer him as to what I was looking at. Well the judge eventually asked me and I again reassured it had nothing to do with the case, but he insisted since the attorney did. So Eventually I read out loud "He puts his pants on one leg at a time too!" Everyone in the court - judge, bailiff and all burst out laughing and the attorney was really embarrassed and stammered to the judge to have that remark be removed. The judge told him it was he who requested the information and refused to strike it from the record.

Even well versed attornies make the mistake of asking questions that they don't know what the answer will be and that is one of the major things to do while in court - know the answer before you ask the question from a witness, plaintiff, or defendant.

P.S. I was found not guilty for any responsibility for the accident. It was totally the other persons fault. Could really get into a lot of stuff about that trial but ....
