The key to the whole indictment appears to be Michael McCrum, now a San Antonio defense attorney, who was once in the running to be the U.S. attorney in the San Antonio-based Western District of Texas, including Austin, Waco and El Paso. But he withdrew his name from consideration in October 2010 after more than a year of waiting to be officially nominated by the White House and went into private practice.

I would guess even in Texas that it take a certain threshold of evidence before an indictment can move forward. If it were easy political motivated lawsuits would be swamping the system.

Any prosecutor can get a grand jury indictment against a phone book. Even liberal pundits think this is BS case with no legs.

Texan political junkie reporting in: IF (and that's a big "if") the case doesn't get thrown out before it goes to trial, I feel Perry will not be convicted if he can get a change of venue away from Austin, which is a hornets nest of liberals. An impartial jury may be hard for him to come by in Austin. As for throwing his hat in the presidential ring, that race may be cast as a DNS (did not start).
