Replace camera?

In 2012, I got thrown from a horse at the age of 68. It was the first time to be thrown in 38 years of riding in all kinds of terrain, breaking a couple of horses, and training a number of others. It was on a ranch and a wild pig had been caught, but spooked my horse in the process of being caged. Tore up my left shoulder and messed up my neck and back still suffering the pain caused by the incident. Although I am not a person that is sue happy, I occasionally wonder if I should have contacted an attorney concerning liability insurance coverage of the incident. Water under the bridge now.

I was in an accident in 1977, i am still in pain and going to doctors for the problems that were caused by the accident. My arthritis is so severe I can’t walk for a long period. Make sure you are checked out from head to toe because accidents come back to haunt you.

Have them pay you the value of your gear and then upgrade your gear.

You don’t have to be in a big rush. Find out what the statute of limitations is for your state. Usually it’s 2 years for bodily injury. Start checking on yourself first(injuries) and then your equipment. Even with an attorney you will have to document this. If this happened recently, there is nothing an attorney can do now until you reach your maximum medical improvement. It will still be a wait. When you do get an attorney, most insurance companies will wait until you are well and your injuries are documented by a medical professional. They may even chose to pay everything at one time. Getting an attorney- as you should- will slow down the process. Start documenting your losses.

I practiced medicine for 54 years. The insurance company will not take care of you. Get an attorney and take his advice. I’d go for a new camera, lens ,medical expenses , lost time from work,etc. Atthis point, you have no idea what subtle injuries might show up down the road, to you or your camera. The insurance company will NOT try to handle your needs, irregardless what they say. Get an attorney that specializes in injuries. One of those guys that advertise on tv. I had a car wreck that sprained my knee. Over 20 years it slowly progressed into a knee replacement.

First off, NOT a guy! No excuse for this kind of response. NOT funny! SHE was walking in the GRASS at her APT, complex. SHE was thrown to the GRASS and her camera went flying! She could have been killed!
Maybe you should take your eye off the viewfinder and take a look at the real world for a minute or two. As good as you are behind the lens, you are STILL a member of the human race. Maybe you should try acting like it!!

I agree that you should have it inspected.
Recently I took my D850 in for a screen cleaning only to find out my mount was bent.
Nothing I noticed.
You don’t want to find out months later something is wrong when it is too late to file a claim.

The attorney will think of things that you wouldn’t. Like potential long term issues.

Did the insurance company say in a written and signed document that they will do as stated. Oral statements from insurance companies are about as dependable as oral statements from politicians. Include the cost of a replacement camera, get the check, THEN sign a waiver if they want one. You can hire an attorney, but they already have several on staff. Collecting through an attorney will probably cost you rather than them unless your lawyer is working on contingency.

You hire an attorney to make sure you get what you should. Did you have pain and suffering? Did you lose of week of life? If your camera fell hard enough to break the lens it fell hard enough to damage the camera. Get a new camera, not used, new. The insurance will be glad to get you out of their hair. If your clothes were damaged, bloodied etc. you need to get even them replaced. You would want to do all those things if you hit someone, so, get what you are entitled to get. Make sure you get the paper work to make sure you don't have to pay taxes on any awards.

Hire a lawyer, he will be on your side. The drivers ins. lawyer is on their side and looking to save them money

Go talk to an attorney or two. Won’t cost you anything and you will know after the initial consultation if you want to hire one. Attorneys of take cases on a contingency basis. They get a piece of the settlement by you will probably come out with a more reasonable settlement. A very good attorney will charge the same as a crappy one. Choose the best. Advertising doesn’t make the attorney better. If you have someone whose judgment you trust. Good luck and speedy recovery.

JMHO, since they already told you they would cover everything, let them do that. Let them replace the camera and the lens. You have been injured, stressed, inconvenienced, lost time, through no fault of your own, but theirs, so let them do all they have said they will do.

Quick update: I spoke to the personal injury lawyer today. She sent me an intake form to complete, and we will go from there. Just want this to be over!
