That is not meant to say your photographing days are over, just that the insurance companies are there to pay for replacements. They certainly make a bundle from the premiums paid to them.

Yeah, you are probably right. I'm not at fault as I was walking on the side and the driver didn't see me. He said he had to go to the bathroom! Feeling very confused today, as if everything has stood still!

Thanks, actually had plans to go to a clinic today and I honestly can't say what happened and why I didn't. Until I got the police report I couldn't remember when the accident happened. It's all a blur. Have lots of brusies and aches and pains. I actually sent my former Physical Therapist a note to ask if he was still there and I don't remember even doing that! I had Lyme disease last year and he pulled me through a very difficult time and we became good friends. He was actually responsible for getting me to be an active participant of the HOG. Don't think I hit my head, but feeling like time has been lost! Admit it's a bit scarey! I haven't even looked at my camera again as it hurt to pick it up!

Thank, you are probably right. I however have a bad history of doctors as I was a premie and spent way too much time with them. Now avoid them with a passion. I had planned on going to a walk-in clinic today, but never made it there. Honestly this entire day has been a huge blur and I couldn't even remember when the accident happened until I got the slip of paper from the officer for the report! Just ache! It feels like I have lost time!

Thanks. I haven't been great with lawyers. The last one settled my mom's estate, and that was a nightmare, so I wouldn't want to use them again. My one client's mom, who has become, over many years of working with her daughter, like a second mom to me, has a lawyer, so I may ask her.

I don't exactly know the state of my camera as I went to pick it up before and my wrist was hurting too much. I just remember something about the zoom not working, but the settings may have been knocked wrong. Will try and check it tomorrow. Need I guess go to a walk-in clinic as I am really aching and the one bruise is bad. I was supposed to do that today, and this entire day has been a huge blur. Hopefully, tomorrow I can, as I don't have any clients to see.

If you accept the offer of the trucking company it may be considered a settlement in-full. Compensation for any physical or equipment damage discovered later might be denied. That is not to imply that the trucking company has any ill will towards you but their insurance company has lawyers who might adopt the view that you accepted the new lens as consideration, and settlement of any claims. The one job of insurance company lawyers is to minimize losses.

It was wise to file a police report. Make sure you have documented all short-term and possible long-term consequences of your body injuries and hire a lawyer to protect your interests.

It is sad that we live in a world of litigation, but we do and you need to protect your interests. You said that your wrist was already compromised prior to the incident. If being hit somehow made the injury worse, or permanent, you have a very significant legal issue to resolve.

Barb it sounds as if you and your friend had a bad day(s). Before anything else, do NOT wait, go to a clinic and get yourself checked out. Sounds like you did some damage that X-rays or some other test will discover. Clinic FIRST for YOU. Then contact an attorney. Do not let this slip by thinking you don't want to inconvenience the motorist. You come first and you will have bills and the need for new equipment you may not have money to pay for.

Having said all of that somewhat legalese mumbo jumbo I am glad you are well enough to get around, to post on the forum and to seek assistance. Please take care of yourself. You have friends here who care about you.

You have wonderful advice here! Please take it all, starting with a friend or medical assistant. You must see a Doctor or go to the ER. And you most definitely need a good Personal Injury Attorney. Look in the phone book or call the local Bar Association.
They know all the pitfalls, literally. But please get checked out physically. Your symptoms are concerning!

Barb. You sound like you have a concussion. I had one from a fall about five years ago. I walked around in a fog for three years. This is nothing to play with. Your fog may be worse due to Lyme I had Rocky Mountain Spotted Fever also. I know what I’m talking about. Please keep us updated on how you are. Go to the ER - NOW!

The liability is clear, and you were injured. You have a claim against the liability carrier of the truck!
Don't be shy about getting your injuries checked out!
Attorneys are lousy negotiators, and they will get 30-40% percent of any settlement you may get.
