The originalists will vote for procedural pragmatism by taking the language into the current political context.
Note what is NOT being argued forcefully:
1) the definition of "insurrectionist"
2) he didn't have "due process"
3) that there must be a conviction
4) whether an "officer" or not
5) that impeachment has to happen first
The crux of the decision is when to apply the disqualification -- while "running" or while "holding" the office. Any off ramp to get a unified vote and avoid ensuing civil unrest is their goal.

Why don't they do what Kim does to any opponent, family or not, sure would cure their problems. Face it 3G, we do not need lawyers and judges to tell us how to cast or votes, We, The People of this great nation get to cast our votes without interference from any and all. If Biden runs I have no choice but to vote Conservative.

SCOTUS set a precedent with the Gore case. There is a reason for that article in an amendment. It should be used when and where applicable. Every citizen should have the opportunity to have their case heard -- that's the mantra we heard for over 60 voting lawsuits. It is no different now.

We've been watching 6'5" freshman grandson in a club volleyball tournament in St. Louis all day. Plus watching one granddaughter playing basketball and the other in swimming in WI. Technology is great

Like I said, they'll opt to use whatever they can to show a unified front for the sake of the nation. That will probably be that while individual states can determine state level candidates, they can't decide on federal level candidates because it could lead to disenfranchisement of voters nationwide.
It's going to be a tough one to swallow for originalists to bring the verbiage to today's political climate, but it's the path of least resistance and avoiding chaos. It will be on procedural grounds and not constitutionality; they recognize the question will be resurrected again should trump win the election.

I will write in Nikki Haley. Neither Trump or Biden are qualified and Trump really sank himself with his remarks at the NRA convention about inviting Putin to invade any NATO country that did not keep its bills paid.

Not so sure about Haley, but if I have to vote against Biden I will vote the Republican candidate. The party is using Biden to elect a vice president that will take his place shortly after inauguration day. We are all played as fools by the parties.
I found that NATO bit to be a hint that a nation not paying it's fair share for defense should not expect protection, it is a legal protection racket.

You may as well vote democrat. A wasted vote for Haley just adds to the democrats agenda. That's why the democrats seem to rule. They stick together. GOP could learn from that.
