It is a local law. I am not sure it is totally "legal" per say (not following state and federal rule not to mention the constitution) the freedom of expression can be used but this would require challenging the town on court.

While doing some research for some I came across this and could not understand it lawfully. Section 5.8.31.
How can they do this?

My first thought was the date of the ordinance implied it may be outdated, and the possibility of being repealed existed. I pulled up Clovis Ca current municipal codes and I did not find any reference to this ordinance. It is very possible that your research found outdated ordinances that no longer apply.

In our state, it is still illegal to drive with pliers capable of cutting fence wire under the driver's seat of your pickup.

In the little town where I grew up, the speed limit when driving around the courthouse square in a motorized vehicle remains 7 miles per hour to maintain compatability with horse-drawn traffic.

Ha no doubt those could be used to cut fences and rustle cattle or horses.

Right and in today's world that law serves as an all-important funding source for the city.

On the other hand, it's good to know that you can still carry a loaded AR-15 in plain view on the same sidewalks referenced in this ordinance.

So I guess you could use it on someone who is violating the “no picture taking” clause!😳

I have seen YouTube videos where people carrying guns in open carry states are still harassed by police saying people were complaining and carrying was "suspicious'.

Interesting. Online searching is not always accurate, but I did not find that information when I pulled up the Clovis municipal ordinance search engine.

It really doesn’t matter much what the ordnance says, try using a photo of anyone without a model release. You might get away with it for a public news event, but just about anything else that earns you money is risky.

In the United States, it’s not “risky” as long as the image is not being used for commercial use. Has nothing to do with making money on the photo. You could sell a print of the photo in an art gallery or on-line, or include it in a book you intend to sell. Such uses have been challenged many times in court so the legal precedents here are very well established.

Ca politicians are just as corrupt as Illinois politicans but much better at avoiding prison.

FYI I grew up in Illinois I left in 1988 I miss the people, but I don’t miss Chicago politics.

Yup.... They address all corrupt. I left My Vernon, Il. Years ago. No future there.
