The obvious thing to me is the bird has a terrible background for the guys shooting at it. They have another photographer in the bird's background. Thus taking away from the bird regardless of where or how they are shooting.
The photographer in the orange hat is shooting with a Pop-up umbrella!
All other criteria are met perfectly ... composition, alignment, focus, lighting, subject, emotion, colors, lasting moment, DOF and exposure - very nice!

Yep, and why is there a guy with shorts on, during a day from appearance, is not a day for shorts people?
It's a personal choice, of course, which I have never understood.
I see more and more people wearing shorts in winter while are wearing heavy winter clothing elsewhere.

Looks like they add all the new numbers to the total of the above equation. The final total will be 40.
I wonder what great photo he is seeing off to the right, that the rest of the photographers are missing. LOL
As a photojournalist, many times I have gotten a better shot that other photographers missed by NOT following the herd.

Who cares; it is a fun photo! How do you know it wasn't set up on purpose? I have a shot from a recent trip to Walt Disney World where the Disney photographer and I are taking each other's photo...just for kicks and giggles!
