I need to know any legal issues that could arise from posting images with random people on the street to a site such as Flickr. Sure could use some info on this. Please Help.

Explain yourself more fully...

In public, there are no issues legally speaking about taking picture of random people...

Not much to worry about photographing in public, unless you intend to use said photos for commercial/financial gain.

Yes it is. In the US you are only restricted in that you cannot use them to advertise a product.

Depending where and whom you are shooting, your biggest concern could be physical injury. If you are close-up, and the person sees you taking their picture, that could lead to confrontational situation. Stay farther back or smile a lot.

I realize this doesn't cover the legal aspect, but there are other things to consider.

In the UK.. as I understand it, if you are in a public place, then you can be photographed withouit your permission. It is how the photograph is used where the restrictions apply. For example, if you photographed a man who's fallen down outside a pub to illustrate a news item about the state of the pavement, that would be OK, but if you used it to illustrate an article on the perils of drinking, that would not be.

I'm curious, is it illegal to use such images in advertising or is it simply that you cannot get the advertising industry to use them for fear of being sued?

What we need here is a lawyer who specializes in photographic issues as a permanent resource. How would you like to see yourself in the background of a billboard advertisement?

I don't think the question is 'what would I like." I think the question is what is legal. Suppose I decided to start a neighborhood 'rag' and went around taking images of people and putting them into that rag. If the images are all done legally, like if I'm on public land as has been stated in other threads on uhh, they why would it be any different for me to put those images in my rag if I took them and how would that be any different to publishing them on Flickr for anyone to see. In step the 'model release' issue. Is that a requirement of stock agencies or publications producers who buy the images of others or is there actually a law against publishing a picture without a model release? I would think that those are false boundaries in that if it's for the newspapers or news magazines, a model release is not required. Do newspapers have to have a model release if it's for an advertisement or is that the responsibility of the company or person submitting the advertisement to the newspaper?

On the topic of public pix, if I am in public, I don't worry if someone takes pix of me at a distance as long as they are not making $$ on my images its like pirating my pix for profit and I don't get the royalties and credit for taking them, I'm getting into photography for financial purposes so I try to keep an eye on that aspect of it, however I am just starting as a "pro" so some of it is new to me
