I have yet to have an owl complain about me using her picture without her permission . . .

A place I frequently go to is http://thecopyrightzone.com/

It has actual case histories and is quite informative.

Here is an article that does deal with children, in this case it is in New York. http://thecopyrightzone.com/?p=1480

But as the article suggests this may not be the same in your state.

Those guys are great - I attended a seminar where Jack Reznicki was incredibly informative about many of the myths and hard realities surrounding copyright and releases.

His advice regarding releases - if you never want to have any anxiety over a picture you took that you want to use on social media or publish in any other form, get a release. The only real exceptions are academic/art/journalism/reportage.

I recently photographed a local county fair in Utah and got an exciting photo of about 8 kids riding a mini rollercoaster. Just wondering what is required to safely publish or display photos of individuals without signed (or even verbal) consent? The children are all 5 to 6 years old and easily identifiable.

Be careful, I do think there are or could be Legal Complications with Minors. I myself am not a Lawyer, but I too am a Photographer and I am interested in what facts you may aquire in any Investigation you might pursue. Please keep Us updated on information you my be able to learn about this Subject.

You need a model release if the image is used for advertising. Don't need it for editorial use. Also, anyone in a public environment is fair game to be photographed. In our society photographing children might get your photo on Megan's list. IMHO. . .don't.

What is Megan's List???

Are you from outside the USA? Megan's list is what many call the list of sex offenders. It is based on the 1994 murder of Meagan Kanka in Hamilton, NJ. A neighbor with a history of offences was the perpetrator. I won't name him because he does not deserve to be remembered. The fact that his history was known to local officials prompted action that resulted in Megan's Law which required the creation of a registry of sex offenders. It was passed in October 1995 a little more than a year after the murder. (That is actually pretty fast for politicians)
It is hard today to remember there was a time when we could not go online and check to see if there were sex offenders near by. This all happened in the mid-90's when getting online was not so common.

I beg to differ with you on your first sentence. I'm speaking from fact. If it is a fair, set up with the contract to which I alluded, it is private. Do not mistake private property open to the public and public property. They are distinctly different.

But if you are on private property open to the public and are in full view of the public you still have no expectation of privacy.
