Local laws accepted as valid by the FAA are applicable.
Some of them are:
Restrictions on where the drone can take off from and land including your hand if you are located in the restricted area.
You can be prosecuted for violations of local ordinances regarding drones that violate privacy, nuisance and other similar laws.
The FAA allows local laws to not be preempted by federal laws regarding banning voyeurism, use for hunting or harassing hunters or putting weapons on a drone.
So just because the airspace is FAA controlled does NOT give you carte blanche to fly wherever or whenever you want to just because the FAA "Regulates airspace".

Thank goodness! I have wanted a drone to experiment with in the past, however, this last year several have been a nuisance where I was visiting beautiful places. It has made me rethink whether I want to pursue this line of photography. I was so angry with the drone operator in one case - if I could have strangled him I would have!

We are our own worst enemies... I’m 107 certified to do what I do and I try to be very respectful to the neighbors. I’ve encountered neighbors upset with what I’m doing and I always take the time to politely talk to and answer their questions. By the time I’m done, I can usually assuage their fears and most think it’s “really neat”.

Unfortunately, some “pilots” are very inconsiderate and arrogant.

This is an e-mail I sent a few days ago to 2 BLM field managers,

Dear BLM, Field Manager

I'm interested in flying a small drone/camera/video (nonprofit) over some areas surrounding Las Vegas, et. al. southeastern area of Frenchman Mountain and northeast and east of Lava Butte. This would be for landing/takeoff and no greater flight height of 300-400 feet.

I'm interested in video and photos of the many Geological formations that exist in the mentioned areas.

Are there approvals established for such drone activity?

Thanks for your help in any kind of clarification, you could bring my way. I'm always wanting to follow all the rules and regulations that apply.

Take off and landing ordinances also cannot be preempted by the FAA as they only control air space.
Ever hear about airport noise ordinances and operation restrictions?
Those are all local laws.

Nuisance ordinances over BLM area is a concern of mine ............... i'm checking into such an issue ...

Whom was it that informed you of the Valley of Fires restriction?

Found this........ I'm not sure how accurate it is ......

"Are drones allowed in Valley of Fire?"

"Turns out drones are banned in the Red Rock conservation area and nearby Spring Mountain state park. I also found that drones are now banned at the Valley of Fire state park, although there is no mention of this on the official web site.Nov 27, 2017"

I didn’t say I fly over them. I can be on a commercial job, and those neighbors get upset. Even though I have not come near their property. They hear and see the drone, and with all the negative media attention they get the wrong idea about what I’m doing.

I was going to purchase a high end drone to fly over and video the amazingly beautiful mountains and desert surrounding Las Vegas. However, after studying the issue, I have found that most areas surrounding and inside Las Vegas have banned flying drones. Anyone know anything about flying over BLM lands out in this part of the world ??????

Flying drones over BLM land is not generally a problem if done in accordance with FAA guidelines. Exceptions might be areas with sensitive archeological sites. Most state and National Parks are also off limits (places like Valley of Fire State Park).

Here is an article that may provide other helpful info. However, proceed with caution. The article list Red Rock area as being ok, but I have heard that recent rulings have placed it off limits.

I wonder if there is a minimum drone flying height where the sound is not upsetting ...... ???

What do you find so upsetting about it? Not trying to upset you just an honest inquiry.

I grew up flying RC planes and helicopters so maybe that is why it doesn’t bother me. I find dogs barking non stop for hours on end upsetting (I get that in the country). A drone for a couple minutes probably isn’t even heard inside a house if the windows are closed.

Thanks Adamborz, your statement, " I can be on a commercial job, and those neighbors get upset." I'm looking forward to drone flying and following the rules, etc. I'm not sure how you think .... I became upset ....... I have not purchased a drone, which drone do you use in your work??

Ahh, I quoted you while you were quoting me lol.

I use a DJI Phantom 4 Pro + for outside video/ pics and the DJI spark for recording inside walkthrough video.

If you haven't purchased just yet I’d be tempted to hold off. The FAA just put out their new proposed rules on drones having to broadcast their ID while flying. Should be interesting to see how that plays out...

A lot of my aerial photos are taken close to the house. Just gives you a unique perspective on the properties.

Below is an old link I have saved of a job I did. As with online social media, the IQ suffers some when uploaded to the realtors site.

Thanks Adamborz, The picture of the house on the realtors website is very nice. I'm thinking I will obtain a 107 certification, even though I will start out as a pure nonprofit hobbyist. I can see, down the road, a possibility of making some money through a video or photo from my drone work. Thanks again, for your information.

When I got mine back in March of this year, my wife laughed and said I would never make the cost of the test back. Lucky I had it, because I was able to fill a niche that an established real estate photographer wanted to get into but couldn’t. She kept crashing her drone even though she had her 107. So, about 125 jobs later in 2019, . I recovered my testing fee, plus the cost of drone, plus a lot of the photography equipment I already had.

Basically if you have your 107 you might find work... if you don’t get it you’ll never know!!

Good luck.
