Out-of-State Sales Coming to More States

"States across the country have moved forward with implementing sales tax collection requirements on marketplace facilitators like eBay following the June 2018 South Dakota v. Wayfair decision by the U.S. Supreme Court. In 2019, 28 states have passed marketplace facilitator legislation to date, bringing the total to 37 states and the District of Columbia that now have legislation on the books.

Several states’ marketplace facilitator laws are set to take effect on October 1st, including Arizona, California, Maryland, Massachusetts, Nevada, and Texas, among others. As a result of these types of laws, eBay will calculate, collect, and remit sales tax on behalf of sellers for items shipped to customers in these states and others."

Meanwhile NH has sued the federal government. Why should we tax someone for something they bought here when we do not have a sales tax?

because the state THEY live in has a sales tax - it's always been the law that you owed the tax in your state - there just wasn't an reasonable way to collect it

NH doesn't have a case for what happens outside their borders. If they don't want to tax their citizens that is their thing. If NY wants to, that is their decision.

The correct term is "use" tax. States which levy sales taxes on internally purchased goods, always levy a "use" tax on goods purchased outside of, but used in that state.

However, you do raise a valid point. The U.S. Supreme Court has imposed itself on a "states only" issue. There's no national sales tax. They used the vague "commerce" and "full faith and credit" clauses to justify their ruling. I don't think the Founders envisioned this.

My preference would be for the Federal Government to collect the sales tax by zip code and remit them to the States.

That would save the shippers from needing to do a lot of calculating and remitting. Instead, they would just remit one list of all the shipments to all zip codes in a State with the amount of sales tax in one monthly statement. The Feds would then send one monthly check to each State after adding up all the various shippers.

No one likes paying taxes, however, our society does require money to run.

what part of the federal govt could collect STATE taxes?

besides, sellers on ebay & amazon don't have to do anything - the taxes are automatically assessed - that's what the new facilitator laws accompiish

The Feds can't even run the IRS fairly and evenly. I surely don't want them to go anywhere near state taxes.
