Anyone know what breed this is? And why is it sitting like this? Do I need to call ASPCA?
I dont know why its sitting like that, but its sure that it's owners aren't depriving it of feed! Looks fat and healthy to me. If you're worried that it can't get up, I don't think that that is the case. If the critter couldnt get up, the ground would be worn away in short order. As for the breed, I would guess that it is a Scottish Highlander.
Thanks ace-mt. Makes sense about the ground, but not sure I agree that its being that fat makes it "healthy." Was certainly a slam-in-the-brakes moment for me, though.

I looked again and think that it may be a charloais cow. Could be sitting in that position to scratch an itch.
Looks like their could be some Brama in the mix.

It's unusual for cattle to sit down like this but I sometimes see mine do it, usually when they get up they'll use the hind legs first but sometimes they like to rub their back-sides a bit.
The time you don't want to see it is if they get stuck like that. Sometimes after a difficult calving a cow can get nerve damage and they'll sit like that and it can take a week or so before they stand.
I agree with the others, Charolais.
