What a pretty little fly. Unfortunately, there are more than 20 families of little 'fruit flies' (a general name, not specific unless you mean either Tephritid or Drosophilid fruit flies, which this is not), each with several to many genera, each with a few to many different species! Not being a fly-specialist, the best I can do is a guess or two.
The family of Pyrgotid Flies is my first guess (no chance of a species name). They have similar heads and spotted wings. The larvae are parasites of June Beetles grubs. Second is a Marsh Fly (Sciomyzidae); the larvae are mostly predators that feed on pond snails. Again similar heads and spotted wings.
In either case, there is no danger to Humans, and only the latter may on rare occasions be bothersome around lights. Adult flies may visit flowers or be attracted to lights.
