It's the same bird. In the second shot he fluffed up his feathers and shook himself. I think he's quite the beauty.

According to Merlin, this is a Red-Shouldered Hawk.
Great shots.

It looks like it could be a "sharp-shinned Hawk."

I think it is a Red-shouldered hawk, but it is very similar in my books. Going by eye color is why I went with the RSH, but it is hard to tell the size of this bird in the photo. If you can remember how large the bird was that may help to be sure. The Sharp-shinned is smaller at about 10", the Red-shouldered is about 17".

From the angles in both photos, it's a little tricky to tell. Yes, it may be a red-shouldered. But from what can be seen in the photos, it also could be a young red-tail hawk.

A side view shot would show whether or not the bird has the distinctive splash of "rust" at the root of it's wings.

A shot showing the tail feathers also would be helpful in identification.

Body size and wing span would be helpful clues too, but can't be determined from these particular photos.

Wow, thank you all for your help! I want to say it was definitely bigger than 12-14 inches, and could have been 17. Here's a side view, severely cropped as he was so far away. Ouch, sorry about the quality. It looks like the consensus is red-shouldered hawk. I'm looking forward to reading up on them, and appreciate everyone's knowledge and help! It was a thrill to see him!

I agree it's not a sharp-shinned hawk. It doesn't have the thick feather above it's feet. I learned this from some hawk pictures I submitted awhile back and the feedback about what it was.
