Mental Health Care Lacking?

I won't go into a lot of detail, but my brother has recently received multiple threats for him and other members of his family from one of his nephews. This harassment has been ugly to say the least and has his wife so upset she is being treated for anxiety, etc. and they are both now armed at all times. Anyway, this guy has a history of being unstable and of multiple law breaking activities and rightfully so, my brother is taking his threats very seriously.

As a result, my brother filed a police report for terroristic threatening and the police took him in for a 3 day mandatory evaluation at the State Mental Hospital. During this evaluation he was determined by two separate doctors to be a real danger to himself and others, yet he was simply released after the 3 day mandatory stay.

I must say that I am shocked that they would determine someone to be a real danger to themselves and others, then release them back into society without any further treatment. I personally think he should be locked up and receive mandatory treatment until he can get a handle on wh**ever it is that makes him so angry and dangerous. However, there doesn't seem to be any requirement for this and I have to wonder why!

If they know someone is indeed a problem, especially if there is a real chance of hurting someone else, why would they just let them go his own way after such an evaluation? I understand that he has rights too, but it's no wonder we have so many nut cases out there shooting innocent people, when they don't any steps to prevent such a thing even when they know there is a real problem. I simply don't get it and wonder what others think about this sort of thing. Frankly, I know that mental health care isn't perfect, but shouldn't there at least be some sort of follow-up in a situation like this?

It’s hard to say not knowing all of the particulars, but even before C***d, out-patient care for mental health was becoming the norm. With C***d, there are probably even less inpatient facilities. I hope there is follow up with him or at least red-f**g laws in place to prohibit his access to firearms.

Part of, if not the root of the problem goes back to a Supreme Court ruling in, (i think 1973) that said you could not confine someone for being mentally ill unless they were a clear danger to themselves or others. Keeping someone in confinement has gotten more and more difficult through the years and adding to the problem is that when a patient takes their medication, they are no longer a danger to anyone. However, once released, in many cases, the patient stops taking their meds and reverts to being dangerous again.
I have no idea what the answer is or how it will ever be resolved, but we definitely need to do something.

Required out patient care would be better than nothing, but apparently is not required (that's what I find shocking about this whole thing)! Anyway, I'm pretty sure his legal access to firearms was taken away with previous offenses, but he certainly doesn't need a gun to hurt someone and gaining access to one wouldn't be all that hard anyway. If he, or anyone else for that matter, truly wants to hurt someone, they will find a way!

Sadly, that’s true. I’ll pray that there is a peaceful resolution.
