Pascrell Demands 126 Members Seeking to Overturn E******n Not Be Seated in Congress

"PATERSON, NJ – U.S. Rep. Bill Pascrell, Jr. (D-NJ-09) today called on House leaders to sanction Members and exclude from the 117th Congress any Members-elect who are supporting Donald Trump’s efforts to invalidate the 2020 p**********l e******n. Pascrell cites the text of Section 3 of the Fourteenth Amendment which disqualifies from service any individuals who seek to attack American democracy, as well as Congress’s power to exclude Members by majority v**e as acknowledged by the U.S. Supreme Court in Powell v. McCormack.

“Stated simply, men and women who would act to tear the United States government apart cannot serve as Members of the Congress. These lawsuits seeking to obliterate public confidence in our democratic system by invalidating the clear results of the 2020 p**********l e******n undoubtedly attack the text and spirit of the Constitution, which each Member swears to support and defend,” Rep. Pascrell writes House leaders. “Consequently, I call on you to exercise the power of your offices to evaluate steps you can take to address these constitutional violations this Congress and, if possible, refuse to seat in the 117th Congress any Members-elect seeking to make Donald Trump an unelected dictator.”

Article I, Section 5 of the United States Constitution gives each chamber of Congress ultimate responsibility to decide its membership, positing that “[e]ach House shall be the Judge of the E******ns, Returns and Qualifications of its own Members.”

Section 3 of the Fourteenth Amendment stipulates that: “No person shall be a Senator or Representative in Congress, or e*****r of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in i**********n or r*******n against the same, or given aid or comfort to the enemies thereof…”"


House Democrats Could Refuse To Seat The 126 Republicans Who Are Trying To Overturn The E******n

"Rep. Bill Pascrell (D-NJ) has called for House leadership to sanction and not seat the 126 House Republicans who have joined the Texas lawsuit.

Pascrell said in a statement:

"Today I’m calling on House leaders to refuse to seat any Members trying to overturn the e******n and make donald trump an unelected dictator."

Rep. Pascrell brings up a great point. The House Republicans who are trying to overturn the e******n and attack democracy do not have to be seated. House leadership can refuse to seat them. House leadership can also sanction these members for their undemocratic attack on the e******n system.

The members who have joined the Texas lawsuit are violating the Constitution and could be denied seating by a majority v**e in the House.

Republicans are subverting the Constitution by their reckless and fruitless assault on our democracy which threatens to seriously erode public trust in our most sacred democratic institutions and to set back our progress on the urgent challenges ahead.”

It would be an extreme step, but if House Republicans continue to attack democracy, House Democrats do have the option of refusing to seat members by majority v**e if that is what it would take to save the country."

If the GOP chooses to ABDICATE their responsibilities and their Oath of Office to uphold the US Constitution, then they deserve NOT to be seated in the House and should be replaced!

AS for the 126(?) GOP house members show them the door and sent them down the road. Use Section III of the 14th Amendment to do it.

I'm not detached at all - there is a growing number who are totally fed up with both parties. Its a shame there aren't more.
