No one seems to have addressed the sculpture and if the artist would OK the usage of any image of it in any media "of any sort and in current use of that may be developed in the future ... "

Or, if the MOMA is technically a "public" space. If you were inside the building, there may be an issue there.

Well, I wasn't under any roof, but I was on a huge patio like area they call the Sculpture Garden, big enough to hold maybe twenty 18 wheelers or so, which has walls around it so you can't get in without a ticket. So, I guess, inside the museum, but not inside any building.
