He was appointed by the president. Any president can appoint any one he wants to any government position (that does not require senate approval) he want's. Many presidents do exactly that. It's not the least bit unusual. You may question his fitness for the job, and/or the presidents decision. But that has no bearing on his appointment. Obams appointed many "Czars" who had the authority to enact regulations with the powers of laws. This appointee has no such powers
