Can I have and display your photo's ?
Twice on this forum, I've seen photo's that I consider outstanding.[ one was of a day lilly a few months back and the other was a blue nightscape, moon over water, just a few days ago, which when lighten up in Photo Shop looks super ]
My question is this, since these pictures were placed on an open public area, is it OK to download, change, enlarge and display them in my home. The day lilly would look really good enlarged in a fabric frameless setting.
Am I stealing someones work or just showing appreciation for a talent I don't have ?
As far as I'm concerned, ANYTHING that is sent into a public site is fair game... Unless, you plan to sell it for a profit, then that is verbotton...

Just because an item is on a site that is accessible to anyone, that doesn't mean that the content is available for public use. Youtube is a public site, but the videos loaded are privately owned and protected. Photographs are owned by the originator and not necesarily meant for public use. Copyright, trademark, intellectual property, and other legal issues all apply.
I'm not an attorney, but I have had some exposure to property rights. Also read the terms of use on this web site:

As a minimum, you should ask the poster for permission, IMO. That is simple courtesy.
I'll second what mremery said. Also...what really bugged me was your word "change" in your question. Would you also like permission to take credit for our work, or by changing, does the photo(s) become your work?
Ask first. I believe most will say yes, but still ask.
My 2 cents: I'm sure a lot of folks here are like me, total amateur, don't have any expectation of making money from my shots, would be complimented if someone liked my work enough to display in their home, and would have no way of knowing if they did so.
But remember also that their are pro and semipro shooters here who also have their work for sale and would be rightfully pissed if you copied for free.
Important to me, though, that you asked this question, rather than just do it, which I think shows respect for other people's rights.
Would be interesting to hear Admin's take on this.
Just because I park my car outside, and don't bring it inside, doesn't mean it's available for all to use as they please. The property of others should be respected even if it's left unprotected. We may not know who owns "this or that", but we all know what "we" own and don't own. I only put MY photos on MY walls, because people will assume they are mine even if they are not.
At the minimum, Just ask permission.
Copyright infringement is illegal. That being said, if you like the images that much, why not ask the owner(s) for permission to print and hang them in your home?

I've said this before: If you post a food recipe that you orginated on a site, does that mean to use it one has to get your permission ???
And the answer to that is NO !
What is the diff between an orginal food recipe and an orginal photo ???
If you see a bicycle without a chain does that mean it's free?
Not that anyone would want anything I have posted here, lol , I still would like to be asked .If you dont ask the photographer then no matter how you cut it , IT IS STEALING ....IMHO
The difference is that an original recipe is basically a 'how to' guide to make some food (for example, apple pie). It compares to someone explaining how to capture that wonderful photo you so love. The beloved photograph, however, is a finished, creative work. Taking the photograph, without permission, would equate more to stealing the apple pie from the window ledge.
I would not have a problem with you following instructions I freely offer. By convention, it is there for all to use. If I want to charge for it, I should print it in a book. Many do that, you know.
Regardless, there are laws protecting the photograph. It may not make perfect sense to some, but it is the law. There are also laws in some ciites that one cannot spit on the street or cross the street while not in a crosswalk. Someone saw a need for it. Therefore, if you don't ask out of common courtesy, ask to protect your own butt.

It is copyright infringement pure and simple and it is illegal. Of course if you ask and get permission, then it would be fine.
